        Hi everyone,
        I need some urgent legal advice regarding a serious salary issue.

        I joined a studio three months ago and have not been paid a single rupee for the work I did. I actively worked during the first month, trusting the process, but when no payment was made, I stopped doing any further tasks. Since then, I’ve been in constant follow-ups with the company, and they’ve made repeated verbal and written promises that payment would be processed “soon” β€” none of which have been fulfilled.

        Most recently, I was again asked to wait until the end of this month after I handed in my notice. I agreed, but in the meantime, I’ve noticed the company is still actively hiring new people on LinkedIn. While hiring is their internal decision, it feels completely unethical (and possibly fraudulent) to onboard more staff while not paying existing ones.

        I’ve already submitted my resignation and have preserved all records β€” email exchanges, chat logs, Whatsapp messages, and even screenshots of their recent job posts β€” in case they try to delete anything or remove my access.

        As far as I understand, to proceed with a legal complaint via the Ministry of Labour, I am required to formally notify the employer again and submit this as proof of attempting internal resolution. I am doing that now, but I’d appreciate clarity on the legal route forward.

        * Is filing through CPGRAMS sufficient, or should I also use the local Labor Commission website?
        * Do I have to wait until the newly promised deadline (end of the month), or can I proceed now based on non-payment so far?
        * What laws or legal provisions apply to complete non-payment of wages after work is delivered?

          There are laws that you will get your salary : filing a suit for declaration in court
          You will have to visit around 30 times to court, and will have to hire a lawyer worth around 2 lacs, it will take around 5-6 years in lower court. The company can challenge the lower court’s decision ( in your favour) in high court – another 5 years and another advocate, Same may go to supreme court another 10 years. Means after around 20 years you will get your Salary ( with all your expenses on advocates and some other penalties)
          In India you have all the laws , but getting justice is toooooo much complicated almost impossible for a common man.
          India’s ranking in delivering civil justice to common man is ranked 107 out of 142 in 2024.
