        I am a psu employee(M35)living in A.P. My wife(F30) is from delhi.Recently she went to dellhi and we had a huge fight…Things were off between us for the whole duration of marriage(2yrs)…Now she is asking for 50L settlement amount before proceeding for mutual divorce. She is employed(6L ctc). I want to contest her claim amount and want to settle for around 10L.
        What is the general outcome( the final one time alimony that court may grant) in such cases?

        Also, please suggest some genuine honest lawer from delhi who can fight this case on my behalf.
        Since I work in a psu, it will be difficult to attend all the hearings in delhi….so I want to take help from a decent lawyer who will fight my case genuinely whithout trying to rip me off.

        Please drop your suggestions….I am feeling a little hopeless right now and need good legal counsel. Any input from you kind folks will be hugely appreciated.🙏

          Well, your approach is practical… opting for mutual consent divorce is the best way to save time, money n mental peace. There’s no point in paying exorbitant legal fees to advocates. Courts decide alimony under Section 25 of the Hindu Marriage Act based on income, assets n other factors, so being flexible in negotiations is wise. If litigation becomes necessary, both parties would have to disclose financial details per Supreme Court guidelines after which the Court would decide the alimony. For a lawyer, personal referrals from friends or family are the safest bet. All the best!!

            ince you are living and working in AP, you don’t necessarily have to fight the case in Delhi. You can file for divorce in AP itself, as courts allow filing at the place where either spouse resides. This would make things much easier for you and prevent unnecessary travel.

            Regarding alimony, there’s no fixed formula, but courts generally consider the wife’s income, the husband’s financial standing, and other factors. Since she is earning ₹6L CTC, a demand of ₹50L is quite high and unlikely to be granted if you contest it. Courts typically award a one-time lump sum based on need rather than an arbitrary amount, and **negotiation plays a big role in mutual divorces.**

            If she insists on filing in Delhi, and you want to avoid that, you can contest the jurisdiction. Shifting the case to AP could put you in a better position during settlement talks. Hope this helps, and stay strong—divorce negotiations can be tough, but you have options.

                  Srry to bother you again…my wife is really stressing on the point that she is going to file a case in Delhi and make me come to delhi frequently….and cause me inconvenience in the process.
                  On what ground can I contest the jurisdiction? I am a psu employee from A.P. Can I tell the judge that my job requies my presence in Plant premises…and hence, attending summons in delhi will jeopardize Psu production?
                  And if I have to go to delhi finally…how many times per year do I have to attend sessions?
                  I have heard that delhi courts allow vc…can I insist on attending sessions via vc?

                      Since you are working in AP, you can file a transfer petition in the Supreme Court to shift the case to your location, arguing that frequent travel to Delhi would cause undue hardship and interfere with your PSU job. While transfer petitions from the husband’s side are harder to win, it is still an option worth trying if you have strong grounds, such as work constraints.

                      If she files in Delhi, I can assist you with the transfer petition in the Supreme Court. If the petition does not succeed and the case remains in Delhi, I can also represent you here and ensure you minimize unnecessary travel by requesting virtual hearings (VC) wherever possible.
