May 5, 2025 at 5:57 amHi all,
My partner and I recently booked a trip to Turkey via a well-known travel aggregator. Unfortunately, it turned out to be a nightmare — unsafe situations, false promises, and major lapses on their part.Some key issues:
• We were stranded alone late at night after a cruise with no transport in an isolated area. Locals harassed us, and we feared for our safety.
• Our itinerary included shared/private transfers, but we were constantly clubbed with random tourists with completely different itineraries, resulting in delays, missed attractions, and hours of waiting.
• One of the key places we wanted to visit — the Grand Bazaar — was closed due to poor planning. The seller didn’t even know it’s always shut on Sundays.
• The support team from India gave vague responses or none at all. The on-ground team in Turkey was unresponsive. We had to follow up multiple times for basic details like driver names or bus numbers, even during late-night travel.
• They submitted our original marriage certificate to the embassy instead of a xerox copy and now we haven’t received it back.
• We were offered a 30-euro compensation, which was revoked the next day saying we didn’t “acknowledge” it.
• The seller misled us at every step, including false claims about hotels, tours, and service levels.We’ve emailed the company, waited for over a month for a response, and now they’ve outright refused accountability. This trip was not only disappointing but also traumatizing at times.
I’d like to know —
1. Can I file a legal complaint for breach of service, negligence, and mental trauma?
2. What would be the best forum — consumer court, civil court, or something else?
3. Should I issue a legal notice before proceeding further?I’ve saved all chats, emails, screenshots, and the detailed itinerary they promised.
Would appreciate any legal insight or advice on how to proceed. -

May 5, 2025 at 9:08 amAs a Lawyer, I can advise you that the best forum to file this case is in the Consumer Court. Under the **Consumer Protection Act, 2019**, you can file a complaint for:* **Deficiency in service** (poor planning, lack of proper transport, misinformation),
* **Unfair trade practices** (false promises about hotels, itinerary),
* **Negligence** (unsafe arrangements),
* **Mental agony and trauma** due to harassment and distress.# Next Steps :
1. Draft and send a **legal notice** through a lawyer.
2. File a **consumer complaint** if no satisfactory resolution is received.
3. Consider claiming **cost of trip + out-of-pocket expenses + ₹2–5 lakhs for harassment**.# In the meantime do the following::
* **Preserve** all communications and records — these are critical.
* You can file the complaint **online** through https://edaakhil.nic.in.
* In parallel, also **file a complaint on portals** like:
* National Consumer Helpline
* Grievance portals like Jago Grahak Jago
* Company’s social media handles (with screenshots).-
