After my grandparents’ passing, their ancestral property was divided among their children.
My father, who was a minor at the time, received a portion without proper vehicular accessβonly a walking path.
Attempts to amicably resolve this with my uncle (father’s elder brother) have been unsuccessful; he denies us vehicular access.
Concerns:
1. Legal Rights: Under Indian law, particularly the Indian Easements Act, 1882, is my father entitled to demand vehicular access to his property?
2. Impact on Cousins: If we pursue legal action to secure this access, could it affect my cousins’ ability to sell their share of the property in the future?
3. Alternative Solutions: Are there non-litigious approaches, such as mediation or involving local authorities, that might help resolve this issue without straining family relations?
