April 8, 2025 at 3:23 pmSo my neighbour is planning to dig his septic tank on the road in front of his house, there are like 5 other household who use that road to go to their house but they don’t care about it. Is it illegal to do it and if he doesn’t stop his plan how can I go around so he doesn’t construct the tank on the public road? -

He can be fined for damage for public property, obstruction of traffic etc I mean as soon as they start digging the road you can call the cops on them. Any lawyer here please correct me if I may be wrong-

April 8, 2025 at 3:30 pmGathering the videos and photos of the destruction should be evidence enough. You can head to the police station to file an fir with that evidence but still due NAL so get more people’s opinion on this

if they fail to give an acknowledgement then you send the same complaint in registered post with acknowledgement due.It is illegal,
You find these provisions in municipal laws.
If he is found digging the road for his septic tank and is found red handed, an FIR can be registered by the police stating that he is destroying the public property i.e, road.-

April 8, 2025 at 3:35 pmI don’t think villages come under municipal authority. Who should I redirect my complain to. Also they are planning to complete the whole thing in one day, so would it be too late if i gather photos and complain later?-

April 8, 2025 at 3:41 pmIf it’s not a municipality, then it would come under the ambit of Panchayat.Then those rules are governed by the Panchayat Raj act of your state.
All the lanes carved out for the walking purposes of the public become the property of Panchayat and are vested with them.
Even if it is Panchayat, it is illegal to destroy the public roads.
Address a letter to panchayat office officials.–if they are planning to dig the road, tell them to stop digging, if they won’t stop, call the police that public property is being destroyed.
If possible record everything on a mobile.-

April 8, 2025 at 3:34 pmThey will learn their lesson soon. One of my neighbours did the same. Some months later a tractor came was passing by and sunk the septic tank roof. They tried to put blame on the driver but Nagar Nigam got involved and fined them for the construction
