March 1, 2025 at 4:19 pmHi everyone,We are a group of 4, flat owners in **Wing D** of a building complex built in 2000. The other three wings (A, B & C) formed a society long ago, but Wing D was never included. As a result, when we check the land records, the parcel for A, B & C is under their society’s name, but Wing D is still under the **builder’s name**.
# Current Issues We Are Facing:
1. **No Society & No Conveyance:** Since we never formed a society, we don’t have legal ownership of the land (still under the builder).
2. **Property Tax Mess:** The **property tax bill is only in one owner’s name** (out of the four flats), and we are unsure if this affects our rights.
3. **Water Supply Cut Off by the Municipal Corporation:** The **municipal corporation has cut off our water supply**, likely due to unpaid property tax or lack of proper society registration.
4. **Common Area Taken Over:** The existing society of A, B & C **has taken over our common area**, restricting our access.
5. **Redevelopment Started Without Us:** The other wings are **going for redevelopment**, but we were **not included**.
6. **No Maintenance Paid:** We never paid maintenance to the builder or the other society, as Wing D was never a part of it.# Our Questions:
1. **What’s the best legal way to form a society with just 4 members?**
2. **Should we go for an Apartment Association instead?** (Is that a better option?)
3. **What steps can we take to get our water supply restored?**
4. **Can non-payment of maintenance affect our rights in any way?**
5. **Is there any legal action we can take against the other society for occupying our common area?**
