Tenant without rent agreement not paying rent and refusing to vacate – what are my options?

Hi everyone, I need some urgent advice.

I have a tenant living in my apartment, but unfortunately, I do not have a written rent agreement with him – it was a verbal understanding. Initially, he paid rent, but for a while now he has stopped paying entirely. On top of that, he has started making repairs on his own (without my permission), claiming certain things were broken, and now says I owe him money for the costs he incurred. This has happened multiple times, and I’ve had enough.

I’ve calculated everything, and the truth is – he owes me rent for all these months. But he refuses to accept it. Frankly, I don’t even want the money anymore – I just want him to vacate my property.

What steps can I take to evict him, considering:

There’s no written rent agreement

He’s not paying rent

He’s refusing to leave

He’s now demanding money from me

I would appreciate any guidance on how to approach this – especially whether I should send a legal notice, file a police complaint, or approach civil court.

As I a Lawyer, I can advise you the following:

1. Send a legal notice demanding outstanding rent, terminating tenancy and asking for possession.
2. Wait for some time and then file a suit asking for eviction.
3. You can file a police complaint only if harassment or threats persists.
4. Collect proof of rent, default and unauthorized conduct.
5. Try to create record for evidence such as whatsapp messages, call recordings etc.

Last october I had asked him to vacate by the end of the month, he asked us to wait till January (all the things done verbally)
Now hes asking to stay till August and i know he will ask for some more time as this cycle is happening since last year.

So my question is…

1.Till when shall i ask him to vacate

2. If he doesn’t vacate, has an outstanding amount and doesn’t pay it what should be my next steps??

I don’t even want the outstanding now (its bonus if he gives it, but i dont think he will), i just want him to vacate that place….
