March 16, 2025 at 1:26 pmI live in a **G+4 residential complex in Kolkata** with 4 flats per floor and shops on the ground floor. The terrace has a small room purchased by a man who visited once a year. Post-COVID, he vanished (possibly dead/absconding). The builder sold all flats (including the terrace room) and is untraceable. In **May 2024**, a local TMC *dada* (**Raju** – relevant due to police inaction) appeared with **forged property papers** and rented the terrace room to a family of 6 (daily wage laborers). The men frequently return drunk, harass residents, and create disturbances. The terrace has a shared gate (all residents have keys).
**Incident**:
On [date], my neighbor’s kids (**12F**, **9M**) were playing on the terrace with their mother (**S**) around 10 PM. The drunk son (**DH**, early 20s) of the tenant charged at the boy with a heavy flower pot. **S intervened**, but DH abused her, threatened future violence (“*how will you use the terrace next time? I’m going to see*”), and locked the terrace with a new lock.S recorded the incident. DH’s wife (**DHW**) tried calming him, but **he slapped her**. S’s husband (**M**) and my family rushed upstairs. M confronted the tenant’s head (**BHR**), who:
* Demanded proof of terrace ownership.
* Blamed the kids for “playing late.”
* Vaguely promised to “discipline” DH.**Police Involvement**:
* M called Kolkata Police, showed video evidence of DH’s drunkenness, threats, and assault on DHW.
* Police filed a General Diary entry, took statements. **BHR attempted to bribe them** (police refused).
* Officers advised “cooperation” and left without action.
* **Raju** (TMC leader, local Durga Puja committee head) arrived, **abused M in front of police**, who ignored it, laughed with him and left.**Current Situation**:
1. DH’s drunken aggression, threats, and violent behavior have created fear. This is their end-goal, so that they can occupy the complete terrace and build a complete illegal floor on there.
2. Other flat owners avoid confrontation; no support during the incident.
3. Police inaction likely due to Raju’s political influence.**Questions**:
1. Is pursuing **legal action** feasible here? Can we evict them via court? How much time would it take legally? Would it be worth the trouble and safety risk?
2. How to counter police inaction? Should we escalate to higher authorities? Or is this a gone case?
3. Should we just move out, given TMC’s influence and neighbor apathy?
