February 8, 2025 at 9:23 amI made a ₹5,000 advance payment to secure warehouse space, with the understanding that a rental agreement and banking details would be provided. Despite repeated requests over 15 days, the building owner has failed to deliver this information. Following this lack of response, we requested cancellation; however, the owner now refuses a refund, citing wasted time and drafting costs. What is the recommended course of action? -

February 8, 2025 at 10:44 amLawyer here.– You could write a strongly-worded Letter/Email conveying them your unequivocal desire seeking refund of money, including stating their default (delays, faults, defects, etc.).
– Failing which, you could send in a Legal Notice;
– Failing which, a Consumer Grievance (in National Consumer Helpline) can be filed;
– Failing which, a Consumer Complaint (in Consumer Court) can be filed;
There may be available other remedies, depending on the facts and circumstances of the case
Of course, a lot depends on the money, time and energy you are willing to invest in this.
