Iโm facing a serious water issue in my residential building in Bhopal and would really appreciate some suggestions.I live on the 2nd floor of a 3-floor building. Until recently, the entire building was using a common overhead water tank that was filled by a borewell. But now the borewell has run dry, and thereโs no water supply through the common system.
Due to this, most of us have installed our own 1000-liter water tanks on the rooftop and get them filled by private water tankers.
Now, the top (3rd) floor owners are saying individual water tanks should not be kept on the roof. Their argument is that these tanks damage the roof and are causing leakages in their flats. Because of this, they have locked the rooftop and are not allowing others to access it. Theyโre even asking us to contribute to roof maintenance if we want to keep tanks there.
My questions:
What are my rights as a 2nd-floor flat owner regarding the use of common areas like the rooftop?
Can top floor owners legally lock the roof or restrict others from placing water tanks?
Is it fair for them to demand roof maintenance money from only those keeping tanks, especially when thereโs no water alternative?
What legal or cooperative steps can I take in this situation?
This is a basic utility issue and weโre left without water while they control the rooftop. Any advice or experiences would be really helpful.
Thanks in advance!
