March 12, 2025 at 11:06 amThe car driving in front of me came to a complete halt due to an obstacle or breaker and I wasn’t able to stop in time due to his sudden stop. We exchanged contact details and left. His car got driven by someone and mine had to be towed.I have submitted my car to my service centre for insurance claim. I have both first and third party insurance.
He has said that since his car is 16-17 years old, his own insurance company has told him that his car is a total loss and they are willing to pay him Rs. 90,000.
He called and told me that Maruti people have told him that his car is worth 2 lacs and that if I don’t pay him the difference, he is feeling back pain and will go to a hospital and then file an FIR against me.
Please advise what should I do?

March 12, 2025 at 12:20 pmEven if he files a FIR, it’s your insurance company headache to pay compensation and not yours. They are responsible since you have 3rd party. That’s the reason you pay premium.Nothing to worry even if he goes to hospital. Worst thing is you will lose the NCB

March 12, 2025 at 12:58 pmThanks a ton. I understand that I need to go to the police station and give my statement and insurance papers, should I bring a lawyer or go alone?Also, would I need to appear in court? Does this have any negative implications for me further down the line

March 12, 2025 at 2:37 pmThe better thing would be to file a complaint before he approaches the authorities, you will need it for insurance purposes as well.If you give in, there is a good chance that the other person will keep asking for higher amount (to the extent you give in).
