Used someone else’s gst number to sell a product to a buisness, he isn’t giving the money back, can i sue

Pretty dumb question, but my friend had some products which he was looking to sell to businesses, he found a buisness, but they wanted a gst number, my friend didn’t have one and didn’t want to spend money ,another friend of his had a gst and complied, he sold the products, his friend had received 40K rs, he gave him the first 16k and said that his ca isn’t letting him to give the full amount. Now, he has blocked him and is making excuses. He came to me for advice, I don’t think he can sue as it’s illegal, but is there some way to sue or threaten him.
