I have come across an unfortunate situation where I might need some legal aid soon.I was working for an organisation as a marketer since 2021. Recently quit as I got a better pay and role in a different city. My last date on paper was 29th December2024. However, due to it being a non-working day, I handed over my assets on the 27th apart from that, I served my entire notice period of 2 months without taking any leaves and didn’t ask for an early exit.
I’m due for an FnF by the mid of February and was intimated by a colleague that they have denied my claim for the variable pay for Q3(Oct-Nov-Dec) because I left the organisation before the 1st of Jan.
This variable pay was part of my CTC(20%) as individual performance-based incentive and was claimable quarterly. Because of internal delays they didn’t pay for 2 quarters (April-Sept) and now they say I’m not eligible for Q3 variable because I didn’t complete the quarter in the organisation but I did achive all the required targets based on my KPIs. And just to be clear, they have agreed to pay my variable for the first two quarters (Apr-Sept).
They have no policy addressing this eligibility.
I need to understand if I were to approach this from a legal angle, how should I go about it? Also, it would be a great help if I could get some leads for a lawyer who can work this with me if there is a requirement.
I’m sure if I give them an option to work it out internally in good faith they will deny it because regardless of having a clean record with them they have hardly ever helped anyone.
