April 13, 2025 at 9:09 amHi,We have a 240sqft room in paghadi system in Prabhadevi Mumbai.
Now this room which is under paghadi system has no particular owner. We are just tenants of this property.
This property was used by my grandfather, my dad and my uncle. Now me, my dad and my mom are only staying here and my uncle left this property 32 years ago and bought another flat for him. Since then (ie 32 years) my family is here and we have all the documents(electricity bill etc of this place everything on my dadβs name and on this address)
My dad is staying in this property and we have maintained the property since 32 years now.
But now since under paghadi system this entire property is under one of the builder (who is the owner of this land) and they are planning for redevelopment.
We havenβt paid rent which is very minimal for many years, but now the builder has said they he is waiving off the rent till date and will start new rent from April 2025 now onwards
He has asked to give names for these rent receipts for which we gave name of my dad and my uncle.
But my questions, is it legally ok or right to give uncle name for rent receipt for coming month?
Will it give him the tenancy rights after this?
Also can my dad claim this property as a sole occupier since he has used this property and maintained it.My uncle is asking to give his name but is it right??
Also my uncle is saying give him 35 lakhs and keep this property to you. Is he playing any card here?
Should we have the authority to pay him whatever we want and get the deal settled?Is it right that if he wants to claim on this property then he has to go to the court? But we should not include him in the upcoming rent receipts?
There are so many questions but if somebody can help me with this!
