The marriage was never registered under Special Marriage Act between the inter-faith couple. The had both the Hindu and muslim religious ceremonies. No conversions. They then had a child and are now fighting in the court for a divorce and custody of the girl child who is a minor.

The marriage is not void merely because it is not registered. Generally the custody goes to mother, in the event of unfit mother then it goes to the father…

Sorry to ask a question and not have advice for you but genuinely curious, how did they have a Muslim ceremony without converting – is that possible? I heard Nikaah is only allowed between Muslims and converts.
