        So both my maternal uncles are fighting for the inheritance. A little background my 1st uncle left home in his early 20’s in search of job and worked in multiple cities like Hyd, Blr and even worked in multiple foreign countries for a few years even their family along with his kids spent more than two years in USA.

        But while my 2nd uncle, never left his home town and is self-employed and financially not as near as my first uncle. He has devoted his entire life to his parents untill their death, both my grandparents suffered from serious health issues for the last 10-12 years and he has given up on something to take care of them.

        My first uncle is just comes to home town once or twice a year, and always wreaked some kind of havoc while leaving, my grandmother died few years back and my grandfather died two years back.

        My 2nd uncle spent so much money for their treatment like spending his entire income on them, while my first uncle contributed near to none and also never visited them while in hospital(very rare).

        He earns very handsomely upwards of 60lpa, has multiple real estate property has shit ton of gold and silver, the only property my 2nd uncle has is the current house they are residing(which is constructed some 20 years back).

        It is after the death of my grandfather, we started getting close like going to each others houses and spending festivals together, in the past two years there are multiple rough patches he asking for share in house and usually it is used to settle in a month and everything would be back to normal.

        After my grandmother died, my grandfather offered my first uncle to take his share of inheritance some gold and cash (not equally distributed) but according to my grandfather’s liking ,which he haven’t liked and left stating he never wanted anything from them.

        Now things are looking not good he(1st uncle)wants half portion in the current house and half of total gold he has (their is no separated property as his and his parents)

        He is saying he will be filing a court case in him and my mother(for supporting my 2nd uncle), he gave my mother what my grandmother said to give some gold and cash.

        While my grandmother was alive she told what to give to everyone including what should be given to her grandsons and granddaughters in their important events in life(some amount towards education and some amount at the time of our marriage).

        The property and gold my 2nd uncle is not even so much (a house which they are residing in a small town and that to not in a costly neighbourhood and gold worth 30-35 lakhs) which is no way compared to what my first uncle has( 2 apartments in a gated community, one normal apartment in a tier – 2 city, multiple real estate sites, lot of gold).

        If this case goes to court will the court consider each individual’s property in to the pool and splits it or doesn’t consider my 1st uncles property), of if he really sends a court notice stating he wants his share of property what can be done. My 2nd uncle is uneducated and is fearing by hearing the words of court and case

          If no will, the property will be divided equally between the two brothers. What each person has earned by themselves does not matter.
