Oil will never mix with water, and if it is as dirty as you say, then potentially it would be for mosquitoes… You can check it yourself…

Kerosene smell could be because they poured it in to curb the mosquitoes that would be breeding there due to all dirty and stagnant water… i think you should just ask about it or get it cleaned.
