January 29, 2025 at 2:12 pmAdvocate here. There’s a presumption under the Negotiable Instruments Act, which covers cheques as well, that any NI paid is for a consideration. In simple terms, him paying you a cheque amounts to the fact that he owed you something and the liability to prove he didnt, falls on him, not you.

January 24, 2025 at 9:56 pmIll tell you a very very basic difference which stems all the other differences. The muslim law is still not codified in its entirety. The reason being that the word of Allah is supreme and as far as personal matters like marriage are concerned, either the Holy Quran or interpretations thereof govern all the matters you mentioned.
The SMA being codified makes the process easier and simpler because one does not have go into the interpretation of religious texts.
Again, every sect in the muslims follows different laws, and no its not just shias and sunnis. The laws differ with different schools- the Hanafi School is just one school, which is prominent in India.
Having said that, there are thosands of differences in each aspect- marriage, divorce, inheritance, legitimacy of children etc- between SMA and the Muslim law, and it is not possible to list them out here for it’s literally an entire subject in itself.
But if you have to choose one, go for SMA
P.S: my answer is just based on MY comparative analysis of the two laws based on hundreds of hours I spent studying them. I mean absolutely no disrespect.DDesisonu9131

Inform your bank ASAP. Ask them to give you a grievance form. All communications with the bank must be in writing.
Thereafter inform the RBI ombudsman. You WILL get your money back.
But you have to be super quick and efficient about it.

1. Yes tour girlfriend can file a case under the posh act.
2. Yes she can go to the ICC.
3. The organisation would constitute an abettor if it tries to ignore it making the management liable. So they wouldn’t.
4. A harassment is harassment even under the IPC.
Your girlfriend should have infact, already taken action because time delayed would tilt the balance away from you.
