May 7, 2025 at 9:19 pmYou’re right. It might. When the lender sends you a notice to honour the cheque that bounced, send a reply notice. Specifically mention therein, with reference to documents that can prove the loan amount was 50k, that this amounts to extortion, cheating etc. Thereafter try settlng at the amount originally owed.

If thr police doesn’t cooperate, you can write a letter to the SP. It’s all he said she said, until she moves the court. In that case, you will have to file an anticipatory bail(depending upon what charges she levies against you). For now, as someone here suggested, you cant do much except record her as well as YOUR tracks. Prepare a solid alibi so you can refute events directly. On a side note, I think a clause of this sort could be hit by S.28 of the Ica. What if you take an alrernate route of heavy monetary damages, because that cant even be proved invaled.
For eg. In case of non handing over of peaceful possession the tenant shall be liable to pay so & so amount to the landlord which is refundable if the tenant’s claim is decreed and all appeals, revisionc etc etc have been exhausted.
What would be the pros and cons of this v. the clause you suggested.DDesisonu9131

If you really want to take some action, there are provisions in the IPC and assuming the threats are online, in the IT Act to help you out. Some of them being criminal intimidation, conspiracy, sevtion 66aof the it act- sending offensive messages through communication service.
