      Wow.. seeing the responses here probably no real advocate is replying to this. For those who are not aware, more than 50% of all cases in India involve the Government or government owned companies. It is not that people don’t file cases against the Government. It is just that media never shows it. Your source of information is twitter, media or movies, which do not paint the correct picture.

      Also, you are wrong about people dying and their family not suing. The fact of the matter is that they don’t even need to sue anyone. If someone dies in India while working in any Company or is seriously injured, then compensation is paid immediately. Just go to labour court and see. Cases where compensation is delayed most likely involve different legal heirs fighting over who will get the compensation (it will be deposited in court till the fight goes on. Company has to immediately pay irrespective).

      The problem regarding lawyers is that in foreign countries it is very difficult to become a lawyer. The law college as well as bar exam are very difficult, and so only good lawyers come out of their system. Even they have to pay a lot for lawyer, but it is guaranteed that the lawyer will be good. In India, it is difficult to fail law exams and bar exam is an open book test. Literally anyone can become a lawyer and that is why India has a mix of good lawyers as well as frauds who don’t know anything and will only scam you.

        If you want to defend him then hire an advocate and be prepared to fight for the next 15 years. Also, if FIR has been filed then Warrant for his arrest will follow.

          Limitation for executing a decree is 12 years.

            Report the incident to the police immediately. If you have any knowledge of any sexual abuse faced by a child, you are legally obligated to report it under the POSCO Act. Failure to do so may result in imprisonment for up to six months. Additionally, if the children provide statements indicating that the individual is touching them inappropriately, this will be sufficient evidence to convict him.

              Always make all complaints etc. in email or in writing. Never rely on oral complaints as they will deny you ever made any oral complaints. Also, try to get some evidence to back up your case. I doubt any employees will make any statements as they might be afraid of retaliation.

              If your organisation has more than 10 employees then it is required to constitute a POSH internal committee. If they have not constituted a POSH Internal Committee then they are already in the wrong. But it most likely is that the HR simply lied to you because they don’t want a mess.

              In any event, If there is no POSH internal committee then you can file your Complaint with the Local Committee. Every district has one.

              Apart from this, you can also directly file FIR against the person for sexual harassment.

                Why do you need help in this? You are not an accused in the case right? Tell the Police that you had no idea about all this and that the worker has run away. You have nothing to do with what was done by the worker. Frankly speaking he is at fault here. Don’t involve yourself in the matter anymore.

                  File Police Complaint… If your local police station is not doing anything then contact SP.

                  If you have video evidence make a post on twitter, tag the police and BJP leaders…

                    Try to record if she ever threatens false case etc. and have some evidence in your favour. Ultimately, there is no other way than to defend the case if she files it.

                    Also, jewellery given to woman at the time of marriage is called streedhan and she has rights over it. But if it is other jewellery (not streedhan) and you have its bills etc. to prove it belongs to you, then you can file a police complaint against her for criminal breach of trust.

                      Tell your dad to to inform them that he lost job and request for a One Time Settlement (OTS) for a lesser amount than what is outstanding. Since you have paid a large portion of the loan amount, I doubt a lot of amount would be still outstanding. I don’t think even they want to take legal action against you in such a situation because that would cost a lot. Was any property mortgaged as security for the loan?

                      They will not misbehave with your mom or sister, but just in case, don’t do anything rash. It will only make the matter worse for your parents. Maximum they will do is to say something offensive to provoke you guys.

                        Send in your resignation and demand all dues to be paid. I don’t think such a company is worth staying at any longer.

                        After that you will need to send legal notice and file case for your dues in court.

                            If she hits you then you can hit her back in self defence. Of course, you will need to be able to show that she started the fight. Also, the amount of force you use should be proportional to the threat. Like if she is slapping then you slap her back and don’t go full ninja mode on her. You can’t use excessive force in self defence.

                              I don’t personally know about the UGC Regulations but the remedy is to file a Writ Petition.

                                  Have you been making representations in writing? If you have sufficient evidence that you are entitled to registration and that your application is being wrongly rejected / delayed, then you can file a Writ Petition in the High Court.
