As per my info in the case for termination by employers : The Industrial Disputes Act 1947 and the Payment of Gratuity Act 1972Β are the principal laws that regulate severance pay in India. And to the workmen category of employees company is legally responsible to pay severance as per employee experience with company. With all due respect, if you know this don’t you think I am right here? Or am I making a mistake?IIndianstar9060

March 10, 2025 at 11:10 amMy last working day will be in next week. Till next week I’ve to submit gadgets laptop + phone. And it’s good offer but aren’t they legally bind to pay notice pay as I haven’t resigned? And also as per Industrial IT act aren’t they supposed to pay me severance? All companies who pay 1 month severance ask employees to resign voluntarily and avoid termination to not pay severance. That’s my understanding till now. I’m looking for a lawyer’s response on this post.IIndianstar9060

March 10, 2025 at 10:40 amYes, but either they terminate or I resign I still have right for NP pay. Serverance kicks in when it’s company decision to terminate me. I do fall under workman category as per Industrial IT act. That’s why I asked. And I’m already searching for a new job.IIndianstar9060

March 8, 2025 at 1:33 pmNP salary is mandatory AFAIK, they don’t even have any option to deny me that, but I think if they want to me resign atleast negotiate it for my benefit. That’s why I thought of severance. I also got to know if company terminates they’re entitled to pay employees some severance based on experience which in my case is 3 years, they probably want to save on that, that’s why I am hesitant to resign immediately and getting opinions hereIIndianstar9060

March 8, 2025 at 1:25 pmIt’s not me who burnt bridges. They have treated me bad at times, not giving increments, I was not getting offers due to 90 days NP.
Now they said they’re restructuring and need my resignation, why should I accept it with happy face with threats that they will terminate me if not?
My manager not even talking or responding as he already knows everything and only HR was in call no other people. They have no honest reason to terminate me. -
