        Do not wait for the notice. Immediately hire a lawyer and try to find the copy of the FIR. The criminal case can be terminated at different stages before the complete trial. I suggest not to wait for that.

          The affidavit won’t suffice as a court decree is definitely required. For a court decree, you need to file a suit for declaration in Family Court annexing the said Affidavit alongwith the Petition. The notice will be issued to your Husband and if he chooses not to come and reply, an ex-parte (one-sided) decree shall be passed in your favour. That will work anywhere you need to prove your marital status.

          Depending on where you are, this whole process may take months and you’d need a good lawyer to make sure any time is not wasted. Thanks

            You’ve not mentioned which state the property is situated in since property laws differ state to state. Also, the OCI status of your mother does not affect her title and interest in the property. It can be transferred but the details need to be worked out.

              Lawyer here. The photograph of marriage alongwith the copy of the invitation card is a sufficient proof of marriage in the case of divorce with mutual consent. You can go ahead with that since it’s easily accepted at least in Delhi and nearby states.

                The best legal recourse for you is to present the cheques to the Bank and get them dishonoured. After that, the colleague needs to be prosecuted under Section 138 of Negotiable Instruments Act 1881.

                Be careful to follow the entire process in consultation with an advocate as the timelines and limitations for a Cheque Bounce case are very strict and one mistake may render the Blank Cheques useless. Then the only recourse left with you is a Civil Suit which is a very costly and cumbersome process.

                  Please don’t get pressured. Once you start living under one roof, a whole lot of legal options open for her and her parents. It is better to fight it out than to adjust. It’s not a one time thing but a decision for the lifetime.

                    Annulment is granted quite rarely by the courts and that too for very specific grounds. However, it is a good pressure tactic to bring the opposite party to the table for discussing mutually beneficial terms of a divorce. The entire thing can be done even if you do not wish to travel back for court process by appointing a special power of attorney here.

                    I’ve secured a mutual divorce for a client based in the USA, where he did not need to travel to India even once.
