NIf you don’t own that premises, you don’t have the rights to stay there if the owner doesn’t want you to. What sort of argument is this? In good faith they do sometimes accept returns but for that the item has to be genuinely wrong item but in this case the product number matches the delivered product model number so they won’t do sh!t here.NBecause you cannot return, it is service center replacement only or if it is defective or dead on areival, then when the service center people comes to install, they have to provide a job sheet with the defect mentioned, then they will replace it. “Section 138, N.I. Act penalizes the dishonour of any cheque which has been issued in the discharge of the whole or part of “any debt or other liability”.
So you need to have a LEGAL way to show that you had a debt or any other liability, which is missing here in OPs case.
NCheque bounce case requires you to have a legal debt/payment due for product services. Just because you had a cheque, you cannot put a case because legally they don’t owe you shit so they can get out easily.NBut make a new contract and increase rent by 100% and tell him if he wants to stay in the flat he has to pay the new rent or else vacate the flat immediately otherwise you will charge new rent.Or maybe as others have suggested, mail his HR.
