        1. This is a classic developer scam, they initially promise free parking to get your agreement, then try to change terms and extract more money later.

        2. Supreme court further stated that the builders or promoters cannot sell parking areas as independent units or flats as these areas are to be extended as โ€œcommon areas and facilitiesโ€ for the owners. Also, the Court said that the developer is only entitled to charge price for the common areas and facilities from each flat purchaser in proportion to the carpet area of the flat. [Nahalchand Laloochand Pvt. Ltd. v. Panchali Co-operative Housing Society Ltd. [AIR 2010 SC 3607]]

        3. Read you society by-laws as well.

            1. In medico legal cases its all about the evidence that you are presenting, rather we can say the case hinges on evidence you present.

            2. Recently High Courts have held that Private Medical Negligence Complaints are Not Maintainable Without Expert Opinion Of Another Doctor Supporting Allegations.

            3. Check if your case falls under the guidelines for prosecuting doctors. These guidelines were laid down in the case of Jacob Mathew v. State of Punjab.

I can guide you through gathering all necessary evidences to build up your case.

As a practicing advocate, here is what I think on your case:

              1. Refusing to sign the NOC will delay property transfer, but the claim of society sounds like pressure tactics rather than legal reality.

              2. Yes, you can contest a will’s legitimacy from abroad through a legal representative with power of attorney. Grounds include improper execution, undue influence, or testamentary incapacity.

              3. A conditional NOC protecting your inheritance interests is legally viable but requires careful drafting to be enforceable.

Most important is their refusal to provide you the will copy. No doubt, It is a red flag. I recommend requesting the will copy as your absolute first step before any signatures.
