      You say your mother owns the property, how did she acquire it? If it’s self acquired or she inherited it from her side of the family there’s not much you can do since she’s still the owner.

      If she inherited it from your father (without a formal will) a partition suit may work.

        File the case and then negotiate.

        You’ll be in a stronger position and get a better price.

          These are benaami transactions – Fraudulent under the law.

          As a first step, both of you sit with your father in law and ask for a full accounting + whatever assets and liabilities have been created in your wife’s name.

          Also check the email and phone number registered with the bank for statements/OTPs etc.

          When you have the full information, see whether you and your wife are comfortable with the situation (this may have been planned as an inheritance for your wife).

          Take a decision only after this.

          (If he doesn’t cooperate, let your wife go to the bank do a re-KYC with a new phone number and email address and take control of these assets. It’ll put you in a stronger bargaining position with him ).

              If your Dadi passed away before your father your uncle can have no claim.

              But why is the Society doing this? Was there a nomination in favour of this uncle? Are there pending dues?

              Send the Society a lawyer’s notice to force them to record their reasons.

                The problem is your father gave him cash. Unless you can prove that this happened he can create any narrative he likes about why he gave you the cheque. It will be a civil matter though.

                  Check that the property is indeed “ancestral”. That is, it belonged to your grandfather’s great grandfather.

                  If it isn’t ancestral, your grandfather can will it to whoever he wants.

                    Fence off the partitioned portions and show proofs (7/12 etc.) to potential buyers early in the discussions.

                    Land buyers generally know that this kind of family drama happens. Gain their trust by showing that the paperwork is perfect.

                      Only the society committee can answer these questions because these pertain to the common areas.

                      If you’re an owner bring it up in society meetings.

                      If you’re renting ask your landlord for help.

                        If you’re a Hindu and your father’s mother is alive she will have a clam to a share in his estate.

                        Ask your dadi for a renunciation of her share (assuming she is agreeable to this).

                        What does the Succession Certificate say about her share?

                          Make sure the title in your grandparents’ name is free and clear.

                          When your father inherits his share file a partition suit t secure his rights.

                            Can’t you get a copy of the 2007 judgement from the court?

                            That may have details of who paid.

                            Also what were the ages of your uncles/aunts in 1980? Were they of earning age at that time to have contributed?
