PAlso make sure your brother does not have any assets or property on his name, as his wife would as the same in case of divorcePFile an FIR if you have all the details but that will escalate things… as then they will file FIR and then police will close yours and keep theirs as their is women’s complaint.PYour brother needs to do practical things that can clear out his liabilities towards his wife.
1- send her ticket of train or bus so she can come back
2- send her some amount in her back so she can survive 5k -7k and come back to live.
3- do an LIC policy with her as nominee so she can survive if something happened to your brother
4- if she still does not come back then Send her legal notice that she has taken her jewellery and yours too.
5- keep all conversations recorded and in WhatsApp chats.
6- don’t talk about jewellery before sending legal notice.PDid your brother gave anything? If she goes to court the court would see if brother pays for her maintenance or not… you can ask your brother to send some money to her 5k-7k so she can survive… and do something keep the transaction details as this will be important. Also send her ticket so she can come back on her own.PIf she has not yet filed any case test then send a legal notice that she has taken her every thing/jewllery with her and also she had taken yours or your mothers too…PIn my opinion if man or women do a self enquiry through RTI regarding each other’s credentials then lot of cases would not happen as a lot of matters are related to credibility regarding each other.Here are some of the matrimonial cases I have seen
A lot of cases are ego driven and could be solved if both parties send legal notice before filing any complaint against each other.
There are lot of cases where husband is living with only one surviving member of family like his mother in those cases he thinks that his mother is being forced to live alone by his wife.
In some of the cases father of bride has dreams of living with his son in law as before marriage they try to find a higher status family and are not able to match the status of husband. And husband after just one year in marriage and having limited resources does not want his father in law to live with him.
In cases when women files criminal complaint and police takes immediate action then husband face charges If he is guilty.
But what if he is not guilty, in those cases the women’s complaint does not have enough material to charge husband and court has to find out the truth. And it takes a lot of time for the court through current procedure to find out who is the guilty party.
Problem is huge if kid is involved.
To summarise through our current legal system
Women is suffering when husband is guilty of charges but they are equally suffering when he is not guilty of the charges.PWrite an application in court, checkout “right to be forgotten”. Then send the court order to Indian kanoon via email. Also email them first if they agree without court order. Maybe send a legal notice if they don’t respond to email.POP hire a different lawyer, also file an application directly In court to get anticipatory bail… based on earlier closure of FIR and continued harassment from those people. If court grant that then they would not be able to do anything even if the FIR is filed.PI cannot comment on what it teaches or not but being psychologically aware is what many people lack when they are young and due to lack of knowledge of their own self beliefs, they tend to deviate towards materialism. Which in some cases lead to bad marriages, radicalisation, etc and all things you read online.Change would start with education and leading people towards a better way of life…
PPeople will only post dreadful stories on the internet, you may not be seeing happy stories being posted as much as you will see the dreadful stuff. Sometimes the search algorithm also shows you like that only…don’t think too much about it if nothing is happening to you. Although if you want to help some women, you can do so through some NGO.
