PYes, write an application in maintenance 125crpc case to get hand summons, the court will provide the same. Then your mom can tell the divorce case judge that he is not giving maintenance and there are his summons for that case and hand it over to him or his advocate And get it in the court order. Then show that court order in 125 crpc case.
Even though if summons are sent it means they are served. So in alternate you can also ask the judge to issue warrants…but they do not do that easily…

If he wears then you may give those as gifts. Otherwise ask him if he would wear it after marriage as you never saw him wearing those before.Also if it’s not in your budget then don’t give.
But communicate clearly through your fiancé or your family as to what they will be expecting as gifts. And that your family don’t believe in dowry.
Also set a clear expectation regarding what your expectations are for your living arrangements and how you would be taken care of after marriage. And what responsibilities your fiancé expect you to do after marriage. And what you expect him to do for you.

PAll those who are not lawyers, don’t give a threatening warning of getting lawyered up to anyone before taking action. You may have to live with the fact that you would be loosing around 65-70% of your income (30% tax, 25% wife maintenance, 10% legal fee) and you have to survive in rest of the income.
