hi, id highly recommend you to get in touch with ngos that deal with asylum. syrian women doing masters in another country would qualify. i would also recommend getting in touch with funding ngos if she needs funding. i’ll not share names publicly for safety reasons.

id also like to speculate, given the fact that she is muslim, and a refugee, it would be difficult to get her asylum in india. but if any European country takes her, the visa issue will be solved without any risk to her.

do talk with an immigration lawyer. ngos also often provide lawyers with experiences like this. especially international ones. but shopping around for immigration lawyers would be a good investment.

ahahahahahaha this is a simple case where both you and your family friend has to show how the 12 lakh came to be. you lot are doing good by lawyers hahaha. this is literally the easiest money.

id suggest you counter sue your family friend again claiming the flat is yours since it was purchased with your money.

that will make the case interesting. and there can be one winner. there is even a little chance you get the flat if you do a war of attrition.

which i highly recommend. you need to set at least one example so other people know not to fuck with you. then you should tell this story in every family gathering.

              DO NOT RESIGN

if it is not working for the company, they would simply fire you. the fact that they are asking to resign, is proof that they have done something illegal.

talk with a corporate lawyer and a labour lawyer. he might get a good pay if he doesn’t resign.

no, the onus of proving innocence is on the defendant and his lawyer. i am aware it is not how either police or judiciary should work, because what you said is just common sense: the investigation department should do a fair investigation. but in reality, they are looking to close a case, not solve a crime. those are very different things. also investigation requires rigorous work. often it is easier to just go with what is on the surface because that way, you save time.

your father’s lawyer should work this out. also, yes there are multiple people but each person will be charged separately.

reaching conviction does take time. it depends on severity of crime, but it is possible to indefinitely delay the case. also it will depend on how you will be treated after. your father might not get any work in certain sectors and profiles because there is a case against him.

i have around 4 and half years of experience.

this will be a long drawn out situation and i really cant comment on how long simply based on the fact that i do not have enough information on the case.

there are also multiple bns sections dealing with corruption. we don’t even know how many charges were brought against him. depending on the sections, he might be looking for more than 10 years. also if cbi is involved, it generally means it will go in their favour. they play real dirty.

yes i’m a lawyer practicing in one of the high courts in india. i deal mainly with violent criminal cases. my business and life partner deals more with corruption cases.

there must be a motive for the police to do this. if this is not. bribery case, it is either a discrimination case or just personal vendetta.

unless you have personal fight with some police, maybe look deeper into your caste

this kind of denial of passport is extremely common with lower caste population. they face it the most when they get either an educational offer or a job offer. more so if scholarships or high salaries are involved, and the work is not manual labour.

tbh, 3 out of 5 lower caste population will experience denial of service because of their caste location. even if they themselves are not aware of it.

unless you have millions and a group of lawyers, sorry, your father is going away.

doesn’t really matter how much proof of innocent he has. indian judges are nepo hire and incompetent. they literally believe 5 log agar bola hai to jaroor yehi hoga

it is to harass lower caste and religious minorities, this is what part of the protests against caa and nrc was also about. proving citizenship is vv weird actually, bc your parents lived there for decades, every neighbor can say you were there. it’s just to harass you.

this also happens: a lot of lower castes in india, especially in bengal, assam etc do not know they are lower caste because the govt treat them as unreserved, but they are similarly subjected to harassment but they don’t know the reason why.

you need to mention what caste or religion you are. your aadhaar should be enough for a passport. this harassment generally happens for lower caste people and religious minorities. you need to talk to a lawyer who deals with these kinda issues. it gets ugly a lot

nothing can be done really. even if they were not high ranking officials, you couldnt have done anything without staying in bengal.

also, why do you need the house? not like any of you will live there. are you looking to sell your portions for some extra cash? or be a regular landlord?

all of you are problematic people. this is not really a legal issue either, because hindu and muslim family laws are pretty clear about who gets what. the problem is none of you would ever agree on what is equal. hence, you all don’t need legal help, most lawyers would just suck you dry for 20/30 years.

                                yall need family councelling.

you can’t make the woman file a case, but what you can do is have her as a character witness for your divorce. if she has had children, you can get them for dna test, and if she got abortion, you need to find the doctors who performed the abortion and make him testify. if she has had an abortion, she needs to accept that she slept with your husband, or find those conversations where your husband has bragged about sleeping with her.

you should also reach out to his friends, some of his friends would be uncomfortable or jealous and would wanna tattle on him to ruin his life. that’s how human jealousy work anyway. but you need to know which friends are likely to tattle and get affidavits from them.

idk your reason for divorcing on paper, but the part about him sleeping with a minor and taking a dowry should absolutely be in the divorce paper. you need to change lawyers if that is not the case.

if your divorce proceeding does proof that he slept with her, the court would be forced to make a case against him in suo motu with pocso. you don’t have ti go outside, just connect these with your dowry case.
