          1. Talk to your wife nicely as if you are ready for reconciliation. Let her say the things in a message or record the conversation. Don’t let your emotions take over.

          2. Talk to the police and convince them that she is trying to file a fake case as you have not demanded any dowry from her. Show them the recording, but don’t hand it over to them. you need them later on (if FIR is filed). If they ask, you can only share a copy. If cops get convinced, they will not file the FIR, they’ll call both the parties, advice and send them away.

          3. You can take your wife to a counsellor, if you feel you can continue with the marriage.

          4. Or else, you can go for a pre-litigation mediation facilitated in the medication center attached to the Family Court or Civil Court. Ask her to agree for a mutual consent divorce. Don’t let her whole family to make decisions for her. You insist that only she will participate in any kind of discussion. Be it with police or counsellor or mediator.

              Blaming you for his violent behaviour is the narcissist trend. Ask your mom to file a domestic violence case in the police station. In the statement mention about this incident and Facebook post also. If you or your mother got any physical hurt, go to the hospital and register a Medico Legal Case. This would help later.

                She can make a Will right away. Let her mention the details of all that she has and how does she want to distribute among the children. If she doesn’t make a will, your father will get a part of it after her demise. Approach a lawyer with the details of immovable property (location, sy no, khatha no. area, etc), Bank account numbers, FD or RD details, gold jewelry description, etc). the lawyer drafts the will as per her plan of distribution. Register the will in the sub registrar office by taking 2 witnesses along. Lawyer himself can take you through registration process.

You need to get hold of her medical records that says she had mental health condition at the time of marriage, which is still continuing and it was not disclosed to you before & at the time of marriage. One or two incidents with minor injuries police may consider it as household fights and may not do anything about it. But this will help you when your mother has to file a Domestic Violence case or Contested Divorce case. Even today if there is any injury, you can go to a hospital and get treated and ask them to register it as MLC.

                            Don’t normalize DV. Every perpetrator of DV says that it is the victim’s fault that he’s/ she’s abusing the victim. this is how the victims are kept quiet. You are brave to speak about it and wanting to take a step against it.

                              If she has agreed for Mutual Consent Divorce, go ahead with it by filing it from India (based on jurisdiction). If you don’t want her to get back to you, you need to talk to her and understand what does she mean by thinking of coming back. Is she sending those texts so that she can make allegations against you that you are not letting her come back to your company?

                              More over it’s only been a month that she has separated from you, you may have to wait for some time (without knowing all the facts, it is difficult to assume the grounds, if you have to file contested divorce). You can communicate with her through emails or messages asking her the reasons for leaving the matrimonial home without informing you. Be aware that written communications can be used by either parties in the court proceedings. So, choose words wisely not to put yourself in any trouble.

                                Not all lawyers/ advocates are the same (as in any other profession). Focus on the one who deals with the specific kind of cases exclusively or mostly. The specialization in one of the fields (e.g. Divorce, Property, Criminal, etc.) is a result of years of practice in that field. There is no need to get any specialized education for that field. You can check the number of cases filed by them through the e-courts portal to have more insight into their practice.

                                You can also take advice from the ones who have gone through a legal proceedings and find out if they were satisfied with that lawyer.

                                When you are consulting for the first time, be very attentive to see if he can handle the case by himself, speaks about the fees upfront (no surprises later), sounds knowledgeable, patiently listens to your issues, doesn’t restrict you with the time limit while consulting, etc.
