        If you have mentioned that you are married in any official document, then you have to apply for change in the status by attaching a certified copy of the court decree.

        If you have registered your marriage, approach the sub registrar (same office where you registered the marriage) and take your original marriage certificate & certified court decree along with you.

                1. It is recommended that you file for Divorce in India. There are chances that Indian Courts may not recognize and validate the divorce orders from other states, on certain technical reasons.

                2. If your husband is willing to go for divorce, the time is significantly less. You can contact a lawyer from your jurisdiction in India and ask them to make all the paper work ready before you land, you can file and get the decree within a week’s time if the 6 month’s cooling off period is waived off by the court.                   It may end up in

                  – She accusing you of rape – police complaint, imprisonment, trial, etc

                  – Money extortion

                  – May pressurize to marry her

                  – If her husband gets to know, may come to your building and create a scene

                  – May end up in murder of maid, you or her husband

                  – Someone may commit suicide, you being the reason

                  – her children could become orphans

                  – and many more probabilities

                    1. You cannot go for a divorce within 1 year of marriage. Here there is no grave danger to life, this period will not be reduced.                             If your cousin has no income of that sort, court will not order to pay that amount. Demanding & granting are two different things. Your cousin has to show his income details as well as his liabilities.

                              If she’s not willing to go to the lawyer or the police, take her for counselling. She needs emotional support, she may open up and start thinking about her & daughter’s future. Once she is convinced she will be ready to take legal action.

                                The alimony & maintenance is decided case to case basis. All the assets & liabilities of both the parties are considered while deciding on the alimony or maintenance. If your wife has no means to maintain herself, you will be asked to give her something. It need not be the house, it can be a fixed amount every month or one time settlement.
