            Mutual Consent divorce is what she has to apply and get the order from the court. there is non Out of Court settlement for Divorce. Both have to discuss and agree on the terms and conditions of the separation first. If he is also earning there is no question of alimony or maintenance that your sister has to give him.               First Scenario:

              There is no question of custody of children. The children above 18 years can decide where they want to live. Regarding alimony there is no fixed rule or formula that puts forth certain conditions to calculate the alimony. The court considers that particular case and assets & liabilities of both the spouses while deciding the case.

              the wife who is not earning currently, has no savings in liquid form, has only a property where she lives with her children, has no rental income either, who has to take care of 18+ years if they are still studying or yet to get employed…. definitely has no means to sustain.                     File a maintenance case asking him to pay maintenance that covers EMI amount or little over that. If the court orders the same, he will have a legal order to pay you that money.                         The Court hall where it is assigned will be under a particular judge or judges (if it’s a division bench). The same judge would hear the matter, it changes only when there is transfer of judges or sometimes if the matter is transferred from one court to another for any technical reason.

                          Stop her from work. Don’t have to give any reason. She may harm your parents, because she came inside the house with her sister. She can bring in more people to do something bad.

                          You can complain to the police only if there is a direct evidence where the money is seen in her hand in the footage.

                          Even if you complain, she will deny or she’ll put some atrocities case on your parents. Worst she may do self harm and blame your parents to be the reason. Giving a police complaint could turn ugly.

                          Your parents can ask her to pay back the money in small instalments, which she will not pay. Let them try asking.

                          IF your parents feel they can’t forget about the 36K, they have to be very very careful about her coming into their property. It could be extreme steps like asking neighbor or a relative in the house while she’s in the house or after securing all the valuables, parents going out of the house until she finishes or more security cameras in place.

                            In the mediation ask her what she wants, not what her family and lawyer wants. Make sure her family and lawyer do not participate in the mediation.

                            If reconciliation doesn’t work, go for Mutual Consent Divorce and close the matter. In mutual divorce the parties decide on the terms and conditions that include alimony also. You talk to her through mediation (again not her lawyer/ family), who should be in a position to understand your financial position and convince her to agree for a nominal amount.                               In that case every time there is physical abuse take her to the hospital and ask them to register as MLC. Don’t tell her much about it. Tell her you are taking her for treatment.

                                Your brother and parents can file counter cases on her. What she’s doing is to defame the family. Also, your mother can also file domestic violence case on her (it is an extreme case of cruelty against husband).

                                  Congratulations that you have succeeded in creating wealth for yourself & for your family. Now that you have money, work on your self. You don’t need CA or Lawyer right now, but a good counsellor. There is no need to be anxious about something unknown. Once you discover yourself, you will be enlightened to choose the right life partner. So, first work on your self and identify what kind of personality your are. When you are choosing the life partner, be open about who you are and openly express all your positives as well as negatives & most importantly your expectations from the marriage. and aske her also to be open about herself. Learn not to be judgmental, rather use an open approach to talk to people and understand them. Look life positively rather being a critic of everything around. With all this, you will be able to look at life differently.

                                  Choose the life partner based on the compatibility rather status, education or such other materialistic things. Take all the time it takes to decide. Don’t start off with the notion that all the women out there, are looking for taking advantage of you. If you are in that mindset, think that all the girls out there are also anxious about getting burnt alive by their future husbands & in laws in the name of Dowry. This isn’t the case in reality.
