        1. If there’s a possibility record these conversations/ telephone calls where they are threatening to file these cases.

        2. Even if they go ahead and file, the police will call your wife’s brother before registering the FIR. He has to make sure the FIR is not filed before he goes to the Police. It is advisable to send a representative to check the status rather going in person. It can be lawyer who can check the waters.

        3. If FIR is not filed yet, he can talk to the police and explain that the accusations are false. If his siter is not even living close by or has not been visiting their house, he can mention that. He has to be very careful here, not to give his phone or any other important document to the police. Remember there is no immediate arrest in such cases.

        4. If the police goes ahead and filed the FIR, they have to take anticipatory bail immediately. Don’t go to the Police Station without bail.

        5. Again you have to talk to the police not to include your wife’s name as she isn’t living with them, so that her name is removed from the chargesheet.

          1. whenever there is a physical abuse, go to the hospital (not a small clinic, a big hospital with a proper Emergency unit) and get the treatment done. Tell them the reason how she (your mom) got hurt. They are ought to file Medico Legal Case (MLC), which will be intimated to the police. Initially police may just call your father and advice or they may not do that as well. But this could be used later to file Domestic Violence case. Also repeated cases on your father may instigate the police to take action.

          2. If your mother is being abused verbally, physically, emotionally, financially she can file Domestic Violence case in 2 different ways.               1. She can file the cases on Dowry Harassment and Domestic Violence. If they are fake, the trial should prove it so. As these proceedings proceed, she has to show evidence for the allegations made. If your cousin is very sure that there is nothing of that sort, he doesn’t have to be worried of the same.

              2. Not being in domestic relationship in the past 1.5 years can be considered by the courts while deciding the Domestic Violence case. This cannot be a deterrent to file the cases. She can file based on the past incidents.

              3. However hiring a competent advocate is very crucial to prove the cases are fake.

                  Under Hindu Marriage, there is no provision for Engagement and also the engagement is also NOT documented. Is it a Christian Engagement? Here they would have signed a document and submitted, which needs to be withdrawn.

                  If the parties are Hindus, no agreements is valid even if you get it done. The boy’s side could be worried about the potential criminal cases against him. A message or an email exchange between them stating that they are not going ahead with the marriage which is agreeable to both the parties should suffice. It can be treated as communication between the parties. Make sure that there is no force, coercion, duress, blackmailing or any such sort of language used while exchanging this communication.

                    You can track your case in the HC website and also login as a mute audience to see what is happening in your case live. It has been really long time that it is getting adjourned. The dates are given on the previous working day late evenings. The cause list will be put up in the website. You can check the cause list, court hall wise. If you know the case number and court hall number check every evening at around 8 pm or later to se if it is listed. If it is not being listed for a long time, your counsel can raise this concern with the Registrar.

                          For your brother’s suicidal thoughts he must be taken to a psychologist/ counsellor immediately. You can try the free helplines if you can’t afford the private therapists. These issues in family life are solvable, it is not the end of the road. Sometimes you need to count your blessings and be grateful to many things that you have instead of bringing in negative thoughts. Show gratitude towards your wife, appreciate for all the things that she’s been doing for you. Whatever you expect from her, do towards her. She will have a change of heart. But the change begins from you.

                          If you still find it is not possible to continue with the marriage do the following;

                          First step is to get help through counsellors or you can try pre-litigation mediation in your local mediation center attached to the court.

                          Your brother can apply for Contested Divorce based on the abusive behaviour of his wife. Let him collect some evidence of the same. It can be videos, CCTV footage, messages, call recordings, photographs, etc.

                              Let her collect the evidence of them demanding dowry. Their verbal abuse can also be recorded. She can file the Dowry Harassment case against her in laws.

                              They can file a case stating atrocities against them. But the evidence that she had collected should prove otherwise. She has to be careful that she or her family to do not use any caste based abuses while recording these events secretly.

                                Your mother knows about his infidelity. The community around you, your relatives and all those who are working in the hotel or known to your father/ his family are aware of his conduct. Unless and until your mother takes a bold step forward nothing much can happen. She is keeping quiet because that’s what most women do. She has fear of getting divorced or separated from your father because she’s fearful of your future, your roti, kapda, makhaan, education, your prospective marriages especially your sister’s. Hence she’s keeping quiet.

                                Only way that you can support here is concentrating on your life, your education and setting your personal goals. Once you are independent, you can help your mother. Remember your flight attendant saying, ‘If you are accompanying a child, first help yourself before helping your child to put on the oxygen mask’. You cannot save anyone else if you are not saving yourself first. You are obsessing over his infidelity and as you have mentioned, you’ve not done well in the exams when you saw his illicit messages. Stop on your track and reflect. Set goals for yourself. do exercise, meditate, learn something new, achieve whatever you want to as your father is still paying for your sustenance.

                                Meanwhile find out an active women’s organization for your mother to be part of. Something where she doesn’t feel out of place. Where she can gel with the peers. It can be a small group of people who are doing some charity work. Somewhere she can develop the courage and get bold to face the storm. You also encourage her to take part in social events in your community or family actively. If there is any chance or any means through which she can earn (even if it’s a small amount) something that empowers her, encourage her to do that. You will definitely see a difference. This may take few months or years.

                                Talk to her when you feel she’s ready about handling your father. Convince her to file for Divorce & Maintenance cases and Domestic Violence Case asking for shelter and protection orders.
