Really bad non legal advice. You can’t predict what the mothers reaction will be. Indian moms are typically more emotionally motivated and affectionate towards sons. Speaking to mother first might not help OP.

Brother needs to be jailed asap. That’ll be a wakeup call to the mother as well

Have you heard of the word ‘insurance’? That’s what this is for. Ask them to file a case in motor tribunal. Your insurance might pay them in 2-3 years.
