      Maybe ask the project manager to release you from the current project. So you’re back on the bench and are supposed to look for another project. Now instead of looking for a project, resign from the job so your 3 month notice period starts.

      Because they are anyway not going to pay you for 3 months as arrears, might as well prepare for your next role and start applying for jobs.

      During those 3 months, go to the office daily and complete internal training.

      As far as blacklisting is concerned, I’ve heard, anyone resigning are always blacklisted unless you’re in some exec role. Further, why would you want to come back to the shitty place? Unless you’re joining in exec roles.

      Also, who deposits the PF for you? TCS or the company you were working for? If it’s the latter there ain’t much you can do. But if it’s TCS, I think it’s possible to take the legal route cause I don’t think they can withhold PF contribution unless there’s disciplinary action initiated against you.

        You should not be working in such places to begin with. They can technically fire you any moment without any possibility of repercussions.

          Please work with a CA to identify if the company is registered to begin with. If it is registered, what’s the type of registration and the headcount.

          A company with more than 20 employees is liable to submit TDS as applicable and PF for all employees.

          If the company has more than 20 employees and you have a way to prove it (any form of employee attendance, etc.) you can also file a complaint with the Ministry of Corporate Affairs and the Ministry of Labour and Employment.

          If there are more people like you, all of you should look into filing complaints with the Income Tax department and EPFO.

          I hope you got the payments via bank account. You would need to present evidence of credit for salary.

          The above information is assuming you’re a full time worker with the company (as per your offer letter) and not a contract worker.

          But be prepared for a scenario where the company may just tag you as a contractor. A company is not liable to deduct/submit TDS nor PF. So while in theory your gross pay is 75K, in reality you’ll end up with your in-hand salary as your actual salary and you’ll be liable to pay taxes from that amount.
