      You have to take local ps under confidence before u do that shit, then police will ignore his hue and cry ….he will be left with no remedy, only partial one under specific relief act where person disposessed illegal can file a suit for re-entry but hardly any one take such futile steps.

        You have to file a dispossesion suit in Rent tribunal of there is one otherwise in civil court

          They may have said that just to diffuse the situation and rehabilitate true owner to their property. possible they have taken B.r.I.BE. from aur Aunt to do the job , but still what they did cannot be legally challenged , written proof is better but verbal promises are equally binding on the party as in such cases court try to draw inferences from the surrounding circumstances, you can give some bank withdrawal or some witnesses to testify in court but problem is since time limitation to file such cuit is just 3 years from money lent , so better is to contact some local advocate and he/she can guide you what is most viable step for you. They may also advice you file a criminal complaint case for breach of trust and some other section , to pile pressure on ur aunt and her family.

            Sorry but police in this case is not acting biased but doing what they supposed to do . You cannot put lock on someone’s property, you cannot deny them access without a court decree.. this is dispute of civil nature , you have to file money recovery suit for money lent by mom .

              No, police is not bound to give u cctv footages, the only thing u can do if FIR has been lodged , Approach the related court and request court to call for status report on this FIR

                Yess that’s police job to find out truth and present their findings before the court which we call chargesheet which is the next process after FIR and that takes time and effort and Until hat period accused can be kept behind the bars in heinous & serious offences.
                no invoice will be needed Simply u have to say it was old ring or family ring ..

                Reason I am suggesting this cause punishment for assault is three months or fine and for simple injury is one year or fine ..such case hardly reach its conclusion…you will also lose your zeal to pursue the case after initial anger settles in. Since India has one of the worst conviction rate in whole world , here punishment lies in the process, the more you make it harder for person the more he suffers.. obtaining bail in such case is not easy or atleast a very expensive process.

                  Reach police station Tommorow, ask them to write FiR and take ur father for medical and secure CCtv if any , …if they deny or neglect then immediately approach to senior police officer SP / Commissioner with written complaint if that doesn’t work then do approach local advocate for filling complaint to judicial magistrate.

                  Trick of the trade : when someone assaults u never limit ur police complaint to just assault… aggravate it to robbery like they snatched Gold ring Chain etc and if there were 5& more ppl that becomes Dacoity, which is of the most heinous and serious &non bailable offences. So when Police Files FIR arrest becomes imperative or if they still resist writing down FIR , on Complaint ,Judicial magistrate has to take cognizance of such serious offence.

                    As per Hindu succession act section 10, a estate of hindu man dying intestate shall be divided between widow, surviving daughters /sons and his mother … So all ur mama property will be divided among 4 sharers , his wife will take 1 share and 2 daughters and Ur Nani will take one share each .

                    So your Nani can legally file a civil suit for her share of property

                    Additional info :
                    Now as per section 14 of same act property of female hindu to be her absolute property so whatever ur Nani will inherit from share of ur mama’s property will become her own and as section 15 the property of female hindu devolve upon his sons and daughter … So ur mother along with daughters of ur mama will be the beneficiary of that property

                        Yes u will have to pay a alimony cause mental illness can only be ground for divorce and here is a catch if u have already filled divorce on the ground of mental illness then court may raise the interim maintaince or filnal alimony amount accounting mental illnesses of ur wife.

                          He will file claim in MACT , IF YOU HAVE INSURANCE INSURANCE COMPANY WILL ALSO BE APARTY , IF U R NOT HAVING insurance then court will decide ur liability on nature of injury sustained plus he can file FIR u/s 279 ipc those are bailable and Compoundable section

                                If he has proof of funds …his ownership can be established and sister claim can be denied and it can be pleaed that in Indian culture it is common practice to buy assests in the name of parents as sign of gratitude and respect… There is case law on it right now I don’t remember name but I can give it you in a day or two

                                  Legally u r not wrong as long as she is 18 and she doesn’t give in under pressure of parents and start alleging you of some serious shit but you know thullas of india they love scenario like this to extort a shit of you ..I will advise you a take precautionary measure if you get call from police beg some time and straight away approach some lawyer and save all your messages and chats on some cloud or other device.
