      What if someone misses the timeline?
      In that case the cheque can be represented again after getting bounce & elapse of said time, right? Or are there some other options?

      His other concerns are unanswered:
      He can hire a lawyer to take up the case or can represent as a PIP, it’s not that he have to appear every day.

      He can ask litigation cost as well & he is even entitled for the same being aggrieved party.

      Apart from that, defaulter can be punished with the imprisonment upto 2 year or fine upto 2X of the amount of bounced cheque or both as it’s a criminal offence defined u/s 138 of NIA.

        Don’t budge! No attention to melo drama, btw what’s the reply from X (Social Media) team, Regional Head and what happened with the legal notice got any reply in writing?

          You have reported to normal CS level 1? SBI has separate team, for fraud/unauthorised txn. Have you received any ticket/ complaint ID? You need take follow up with the SBI as well as Police. Haven’t you found where the unauthorised txn took place at which ATM & its location?

          1st RBI BO then Court.

            See, this should be investigated, not reported on time? When should it be reported? Before txn or what, do we get dream that fraudulent/ unauthorised txn is going to happen ? You reported on the same day, right? It’s all right. You could have blocked the card yourself or contacting to …1109.

            You haven’t replied the last part of my comment. Take this matter up, don’t just interact with your branch.

            P.S: You haven’t even disclosed required data like dates and all that which is not that private or prone to some risks.

              Check if you have received txn alert (SMS/E-mail), SBI is totally shit with the alert, sometimes it comes and sometimes doesn’t.

              There you fill find ATM number/code, ask SBI to check CCTV of the same, it will be proved that an unknown & unauthorised person has used the card.

                Just ignore, they have no locus standi, they were supposed to take it back, you’re not supposed to deliver the defective item.

                But don’t forget to document proofs, all communications, keep everything, can be used, if & when required.

                  It was not several debt taken on several dates.
                  I don’t know much, but don’t think it will apply like that, though I can be wrong, give refrence of any legal provision or case laws if any to support your argument.

                  It’s blank cheque so I assume there’s no date. Totally blank, except signature.

                    It’s time barred debt means as per limitation act, isn’t it? If it’s so as 3 years has been passed, it becomes unenforceable aggreement.

                    He has sec. 138 of NI Act route I guess, as he mentioned that he paid cheque into bank and it was dishonoured and same was communicated to him by notice 6 months ago.

                      No, bro you can’t.

                      The co. is even entitled to recover even intrest that one has earned during such period.

                      But in his case, it was waived off.

                          IG, Court will presume it as 3% p.a. compounded yearly.

                          Or may set aside as void citing ununconscionable bargain or can alter contract, modifying term(s), as court may deem fit.

                          Lastly, it depends upon the argument between both the parties and judgement of the court (judge (s). ๐Ÿ™‚
