      If the proceedings in High court is for quashing the FIR, then if the mediation fails, the High Court will decide the case of quashing of FIR, and if the FIR is not quashed, the matter will proceed in the trial court after the investigation is done by the police. Other cases will fellow as per law.

        Section 498A IPC is not applicable because it is filed by wife against her husband. Since they were not married, there is no question of Section 498A IPC. Just engage a good lawyer to help your friend out.

          Police cannot further investigate the case. The police have to file a final report in the court, which will be accepted by the court and the case would be closed (this is the procedure adopted in Rajasthan). Once FIR have been quashed by the High Court, parties involved need not worry about anything. Hope this helps.

            The best thing to do is to ask for guidance from one of your seniors who is pursuing master’s abroad, or getting in contact with someone who is pursuing master’s aboard. Although, in my personal opinion, one can manage preparing for a government job while pursuing LLB. Don’t decide in a hurry and go for master’s only if you are interested in doing master’s and think that it will help in your career.

              When you file a compensation/claim, the liability generally shifts on the insurance company if the vehicle is insured. So if you have the vehicle number, you can find out which company has insured the vehicle, thus helping your claim in the MACT court.

                I am sorry for your loss. Unfortunately, the conviction rate in death by accident cases, i.e section 106 BNS, is very low. Almost all FIRs mention the vehicle number and not name of the driver for the sole reason that it helps in your claim action in the MACT court. I am sorry for your terrible situation, but getting criminal liability affixed would be tough.

                  Legally speaking, yes if you both are Hindus and have married according to your personal law. Hindu Marriage Act applies to people domiciled in India, since you are Indian Citizens, it applies to you. However, if that is not the case, you should have taken recourse to the provisions of Foreign Marriage Act while solemnising the marriage.

                    Contact a lawyer, your issue will be resolved within days, it’s not that hard to get a certified copy of a closure report.

                      Just wait and watch, maybe this person is someone who wanted attention from your sister and didn’t got it, and this might be his last pathetic attempt at getting attention. Ensure your sister has all the supports she needs now.
