Because rape is an offence against women. And a man is not a woman? The experts who drafted the section of rape can answer you question properly. For now the definition of rape is given under section 63 on the BNS which is as follows :-

            1. not a rape
            2. No definitive offence. Can be put into the criteria of offences against body like hurt, grievous hurt, assault etc depending upon case to case.
Earlier max having sex with a man (w or w/o consent) was a crime under sec 377 ipc but it was read down by the SC.

Gurur bramha gurur vishnu gurur devo maheshwara. Never sue your teachers. Anyway how old is your brother and what did he do? If the reason was genuinely not slappable just confront the teacher and make a complaint to the principal.

Since there are no explicit guidelines defining what constitutes a “rarest of rare” case, it is left to the discretion of the judge to decide. This discretion is exercised based on the specific circumstances and facts of each case, taking into account factors such as the severity of the crime, the intent and actions, and the overall impact on society as we follow deterrent and reformative theory of punishment. Ultimately the judge’s decision is guided by their interpretation of the law and their understanding of what constitutes an exceptionally heinous and egregious offense.
