See, it all depends on who approved the use of the materials was the decision taken solely by your father? There are many other questions as well. So, it can’t be determined like that without knowing the facts, the actual situation on the ground, and the specific charges involved

It’s better if your FIL assures your BIL that the properties will be distributed according to his wishes. They should hire a trustworthy lawyer to take the necessary legal steps to execute this properly. Assure them that you won’t interfere in the matter, so your wife remains safe. Let the lawyer handle everything discreetly, and inform them only after your wife’s delivery. Until then, allow the matter to remain pending.

Just send a legal notice, don’t file an FIR as for now. Try approaching the person by stating that you will file a complaint for mental harassment and seek double the amount as compensation.
