      If the ceremonies were performed, marriage is considered valid in India, irrespective of registration. Since you guys are headed for a mutual divorce [if I understand correctly], you can mutually decide as to who’ll get what. It’s the best way out. The process is also easier, divorce will be granted within 6 months or lesser.

              Which state/city you’re from? Fee depends.

              SARFAESI proceedings can be stalled for technicalities, so if you want to obtain a stay, you need to show some illegality in the procedure.

                Hi,

                To answer your queries, we need to assess whether the house was mortgaged under CGTMSE? Whether there was a cross-collateralisation clause in any of the docs signed. Whether there was any personal guarantees given by your parents/wife against CGTMSE loan? What kind of proceedings are going on before DRT? Is it SARFAESI or RDDB?

                This will require an in-depth analysis. We’ve recently assisted a client in a similar case where RC for personal properties were issued while loan was in Partnership’s name, and the property was not mortgaged for a different loan, which cannot be the case.

                  Then you should file an Application before the Magistrate trying the offence. Alternatively, you can also file a Writ Petition, however writ process will take some time, whereas application will be decided faster.

                    Hi,

                    Lawyer here.

                    So as per law, they can freeze amounts in your bank a/c related to cybercrime, but only to the extent of the proceeds. For instance, if you withdrew 50k from this betting app and you have 1L in your lakh, a lien can be put only upto 50k.

                    So, first write a letter to bank asking to put lien on the limited amount. Also ask them for details as to which cyber complaint/FIR this amount is freezed under. Once you have the relevant details, you can file an application before the concerned court seeking defreezing of your Bank A/c.

                    Please don’t pay any sum in cash to anyone. Also, I practice in Delhi, so if you can give me details, I can help you out.

                      First figure out who actually caused the accident. Then have the dependants of the deceased persons file an FIR against such person. The dependants are entitled to compensation under Motor Vehicles Act, which will be payable by the insurance company with which the offending vehicle is insured.

                            Yeah, some advocates do charge reading fee or opinion fee you can call it. Because even for them to advice you on something, they hage to spend their time.

                            It depends though. Not all lawyers charge it.

                              Why would a lawyer charge %?

                              Parties are settling amongst themselves. Lawyer is only entitled to his fee as was agreed upon initially.

                              If the lawyer is making special efforts to get the matter settled, then you can agree to a fee for these efforts. Otherwise, nothing is payable.

                                  Yes, but the virtual courts may not operate everywhere in India. Few states have gone virtual but many districts do not have the facility.
