      In a residential zone in Delhi the noise limit level is 55db between 6Am to 10 PM so i think the only bet you would have is by trying to push health issue but even then, if the law allows that level of sound, i dont think they will be barred from the same, especially as they are within limits.

        The legal recourse would be to adopt her if you are married ofc.

        But ill suggest that you can keep your sister’s daughter with her maternal grandparents without any legal implications, subject to the consent of her father.

        I believe he will agree if he is going to remarry so you both can have what you want without going the legal way.

          The court will consider if your plea is correct or not.

          >How to file it

          You’ve to draft it either yourself or hire a lawyer. In the WP You’ve to say that your rights have been violated (You’ve to specify which FR) and hence the rule is illegal/unconstitutional.

          Now before you do this though, You’ve to get something in written from your PT teacher or principal. Approach them stating your issue, with an application, wait for them to take whatever action they take, then file a WP in court.

          Court will hear you and decide if your plea is valid or not.

          It’s an application you file at the court if your fundamental rights are violated seeking some remedy. You can approach High court under article 226 and Supreme court under article 32.

                I agree. We are humans after all. And, as a matter of fact, humans are social animals. Society has certain set of rules to prevent everything from erupting into chaos. Certain rules that are enforced. Certain limits on human freedom. Infact, the concept of city states, if you read about them, was more or less the same. You agree to provide some of your rights to a certain person “(read the ruler) to protect you from harm from invaders. So youre not exactly free to express in any way you want. There are certain reasonable restrictions to your freedom.

                I mean the people making this rule certainly do not agree with you. But if you think the rule is unfair, you can file a WP and take your chances.

                  People here dont understand that rights arent absolute and are incidental to you following a certain duty too. If you dont follow your duty, your rights can be curtailed. Your duty is to maintain discipline at school. Discipline encompasses various facets, including discipline in appearance. If public schools allowed everyone to get their own hairstyles the uniformity that our education system aims to have at public schools shall be disturbed.

                  In public schools the rules are same for everyone. Its to enforce uniformity and prevent distinction/groupism between children. If children are allowed to dress and style as they like, the income and cultural disparity will soon reflect even in school, the only place we are expected to mingle with anyone irrespective of anything.

                            Sale or lease i guess.

                            From what I understand, you have the RoRs in your favour. You’ve the posession over the rest of the land (except the area the other party is claiming).
                            What i dont understand here is how they got the ikrarnama in favour of your land from a person who doesn’t have his name in RoR( basically he dosent have the title to the land).

                            If the case is as simple as someone encroaching upon your land, you can file a suit for permanent injunction against Ops from restraining and in the meantime file an IA seeking temporary injunction against defts.

                            But, if there’s something more to the case, it can take a different turn. Obtain a xerox copy of the ikrarnama if you dont have that yet and see the way they are claiming your land. (Try at tahsildar office and they might ask for some money and the clerk will get you a xerox copy)

                            In these kind of cases mostly the issue is wrong recording in the new ror where either tha map was wrongly prepared or the RoR is short of some portion of lands. Either case, as a lawyer, we need physical documents to trace the issue.

                            Find a good civil lawyer and show him your papers, he will tell you exactly where the issue is

                              If yes then how did he get the ikrarnama?

                              Do you have a certified copy of that ikrarnama?

                              And pardon me kf im wrong, but I guess ikrarnama is the Sale deed right? The names are different for my state so im a bit confused but google tells me that it’s the Registered sale deed.

                                Who’s name is in the RoR? There should be 2 RoRs. The old one(before settlement) and new one after settlement. ?
