April 27, 2025 at 4:51 pmLawyer here. First step for you would be to either file a written complaint or go in person and narrate your incident to the police officers. Although if you say that the perpetrators might themselves be in the police, you could get drafted a well versed complaint by someone experienced (so they could include all the major ingredients of cognizable offences made out). A written complaint is preferred because it will be a part of record. However if you do not prefer this way, chances are that they will have an upper hand over you, simply because of their quick action.BBrightseeker9869

April 27, 2025 at 7:15 amYou can’t keep filing exemption applications successively. Warrants get issued. So that’s not a permanent solution.BBrightseeker9869

April 27, 2025 at 6:45 amLawyer here based in Delhi. Im not sure what does your advocate mean by ‘getting an exemption is the only option’. Depending upon the facts and circumstances, you ideally would have to seek permission from the court to travel abroad. Although im guessing that it must only be a complaint and not yet an FIR. Even if its an FIR, it must be registered under Non cognizable offences so hire a smart lawyer who could settle this matter once and for all.April 27, 2025 at 6:41 am in reply to: Need Legal Advice on Car Sold to Hyundai Dealership – Now Linked to Criminal Case #7465BBrightseeker9869

April 27, 2025 at 6:41 amLawyer here. This situation is indeed, not very uncommon. Regardless of this being true or not, you could sue Hyundai over multiple charges – both civil and criminal. Ask the police officer to send you the FIR details if they ask why, tell them that your lawyer has told you so and you have the right to obtain the copy.BBrightseeker9869

April 27, 2025 at 6:34 amLawyer here. Yes it is very much possible to file an FIR right now. You could approach an NGO if you have one in mind, else you could do all by yourself. The identity of a woman is kept very discreet in such situations but it is also recommended that her family should know about all the details first.BBrightseeker9869

April 26, 2025 at 5:45 amJust read your updated version of post. However i would like to clarify that your physical presence would not be required and secondly lawyer fee is not an issue to be bothered about as well. Last but not the least, you could very well claim additional damages and not just your medical expenses.BBrightseeker9869

April 24, 2025 at 5:51 amLawyer here. You have a right to recover compensation in the form of either money or treatment along with added compensation for your mental agony. Ive had seen similar cases in past and you have a strong case, provided if you pursue it diligently.BBrightseeker9869

April 23, 2025 at 6:30 pmLawyer here. You do have various ways to approach this issue, one of them would be to file a suit for partition along with declaration and/or injunction. Although other facts which you haven’t disclosed yet might be taken into consideration as well.BBrightseeker9869

April 23, 2025 at 1:18 pmThere is no definite timelines for these cases. It depends upon a lot of factors. It would surely take a couple of years to arrive at courts decision but sometimes builders approach complainants for settlement earlier.BBrightseeker9869

April 23, 2025 at 9:35 amLawyer myself based in Delhi. The unfortunate situation which you are experiencing is not uncommon. It all comes down to how do you wish to settle the differences. The settlement could be as simple as counselling or a much more drawn out process such as a divorce decree through intervention of courts.BBrightseeker9869

April 23, 2025 at 6:11 amFile the case in consumer court. I’ve had the opportunity to contest and later win such cases. Although I’m a lawyer based out of Delhi not Mumbai. -
