February 21, 2025 at 10:20 amYou’ll have to look into the agreement you signed. Are you a limited or an unlimited guarantor? Either way if their account is declared as an NPA the bank can and will proceed against you and your friend. Keep an ear out and see if they settle the dues or not. I’d say prepare yourself for the worst outcome. Since you’re a guarantor to a corporate debtor, they can very well move for insolvency if you don’t pay. If you have any assets, either sell them to pay off the debt if you’re so inclined or go the unethical route and transfer them to your wife/husband/parents/siblings so they don’t come after them. Either way you’re gonna be stuck paying the amounts since you signed as a guarantor. I’m not sure what a primary or a secondary guarantor is but it’ll probably be clearer in the agreement.BBrightwolf5745

Also, idk what it’s called in Gujarat but the English term is something called an extract from the town survey land register. That will very clearly mark the boundaries of your property which is proof of your ownership. It’ll be a long and hard battle but don’t give up. If they file a complaint, they’ve filed it. Co-operate with the police. If an FIR has been registered, then have an advocate collect a copy so you can follow the procedures according to law.You’re worried when even a complaint hasn’t been lodged.

And I agree with you, police are really bad at their jobs which is why the conviction rate is abysmal. Easily corruptible cause of shit pay. But one can’t live life believing there’s no point in trying. The law helps those who help themselves. At least some relief will come if you pursue the matter instead of giving up. -
