        Ipc and bns are the same. They’ve added more sections to it and of course are politically motivated to move away from colonial era laws. It’s annoying to say the name though. It’s a mouthful

            It differs from state to state, but essentially it’s a law that protects employees in shops and establishments, similar to how the industrial disputes act protects workers and labourers. It provides protection to employees as well, so they aren’t arbitrarily fired for no apparent reason. For example section 41 of the TN shops and establishments act talks about notice of dismissal and how such dismissal must be carried out. It differs from state to state. Like I said, approach a lawyer, don’t let MNC win

              Hey. It looks like you’ll need to find a lawyer well versed with the shops and establishments act for the state you were working in. Don’t let these naysayers tell you anything else. Fight it out. MNCs get away with it cause no one fights them back. It’ll take time but eventually they’ll come to you to settle cause they’ll spend more money on lawyers than you ever will.

                You can record a conversation you’re having. You cannot record a conversation that 2 other people are having. Besides, if you’re worried about self incriminating, criminal cases are hard to prove bro. Give it like 3 years and you’ll be acquitted. All you need is a good lawyer who will hire an “expert” to give evidence. And any doubt from there on is good for you. The conviction rate in india is abysmal.

                          The cost of your writ petition will be around the same as if you had paid a bribe. A good lawyer will charge you somewhere around 20-40k for this. It’s a simple issue.

                                It’ll take time but eventually you should be able to get it back. Not soon though. You’ve made the complaint almost immediately too. Don’t use the lawyer flair if you’re not a lawyer. The flair is for posts by lawyers or non-lawyers.

                                  Sign a poa to a relative so you can file a case to quash the fir before the HC. While the HC does take a dim view of quashing fir in cognizable crimes, you will have a good luck going through the high court.

                                  It’s very simple, go through the FIR and see if ther s any specific allegation. If it’s a bald allegation like, “he used to hit me all the time”, shit like that won’t fly.

                                  Also if the incident happened outside of India, that’s all the more reason it’ll help your case. Besides, other than 351(3) it’s not cognizable at all.

                                  But make sure you don’t even bring up the word evidence or proof in court. The moment you do so, the judge will say take it to trial.
