                    A discretionary trust is a trust that decides who the beneficiary is. The court will impose orders on maintenance on the basis of an affidavit of assets and liabilities. Trust is not an asset that belongs to you, the trust decides whether or not you benefit in a discretionary trust. Regardless of that fact, you lie in an affidavit just because your income is hiding in trusts overseas, and if you get caught, you’re screwed.

                      You’re thinking of discretionary trusts. Since the trust controls the fund and decides who it goes to, when it eventually does, it’s already taxed at the hands of the trust. You don’t need to maintain off shore accounts for this.

                        Make sure it’s an actual court order though. You can do that by searching the case number on e court services. Check the case status and the order and make sure it’s the same.

                          Only if you challenge the order. Tough luck man. See if you can talk to the bank into letting you stay till you find a new place or see if you can buy it from the bank.

                            You’ll need a lawyer for this not reddit. Does the notice say anything about a court order? Because that’s the only way the dcp is getting involved. Otherwise it’s a scheme to recover money. If the property is mortgaged, you’ll need the bank to sign off on the sale. The bank probably wants you to pay whatever the guy owes for the property. Or you can wait for the bank to eventually seize the property and you can buy it once they auction it. You’ll be competing with estate developers and shit but who knows, you might get it for cheaper.

                              There is no average cost. Us advocates cannot advertise. Some people say 50, others will say 80. The best way for you to get a good advocate, is someone who is up front about their fees. Ideally, go to a small law firm, or a solo practitioner. The latter will be cheaper, the former will be more professional and will be far more accountable because they have a lot more to lose.

                                Depends entirely on the money involved. You’ll have to consult a lawyer. A good one will give you a breakdown of his fees. He’ll tell you to pay an advance, then pay him per hearing and every application he has to file. Any advocate who says I’ll only need so and so and I’ll take care of it, will ask for extra money in the end. Go to many lawyers. Hire the one that’s upfront about his fees.

                                  Being a guarantor is never a formality. Get that through your head. Never ever sign a guarantee agreement unless you receive part of the profits for the risk you’re taking.
