Trust is not an asset that belongs to you, the trust decides whether or not you benefit in a discretionary trust. Since the trust controls the fund and decides who it goes to, when it eventually does, it’s already taxed at the hands of the trust. February 21, 2025 at 4:19 pmYou’ll need a lawyer for this not reddit. Does the notice say anything about a court order? Because that’s the only way the dcp is getting involved. Otherwise it’s a scheme to recover money. If the property is mortgaged, you’ll need the bank to sign off on the sale. The bank probably wants you to pay whatever the guy owes for the property. Or you can wait for the bank to eventually seize the property and you can buy it once they auction it. The best way for you to get a good advocate, is someone who is up front about their fees. Ideally, go to a small law firm, or a solo practitioner. He’ll tell you to pay an advance, then pay him per hearing and every application he has to file. Any advocate who says I’ll only need so and so and I’ll take care of it, will ask for extra money in the end. Go to many lawyers. February 21, 2025 at 10:23 amBeing a guarantor is never a formality. Get that through your head. Never ever sign a guarantee agreement unless you receive part of the profits for the risk you’re taking. -
