      Even after an eviction notice has been served by the court , the tenant can still take you to court if you change locks or if their stuff is there.

      Just because people do it and manage to get away doesn’t mean it is legal.
      Before initiating any action how your tenants are . If they are fearful they may avoid court case but there are people who do exactly this to save on rent expenses . Recently there was a Dr. Who did the same thing for several months.

        Entirely at the discretion of the judge. This is the reason so many contradictory orders come out.

            Maybe you can get there undertaking on stamp paper and / or a cheque if they are willing to give. I don’t think it is legal for individuals to give loans on interest so a civil recovery suit for borrowed amounts seems to be the best bet.

              If done very recently try to attempt a chargeback on your credit card if possible.

                This depends on a case to case basis. Usually in such cases if there are no kids and wife is also working the amount of maintenance is not high however there are cases where court wants to ensure that she is able to live a lifestyle similar to earlier wherein more money is given.

                Flats though not given away by courts are often a part of the settlement negotiation especially if DV type cases have been filed.

                        Divorce in muslims is slightly different. If the man is not willing to divorce, it may take a while. First thing to read is the nikahnama what all provisions are mentioned there .

                        After that she can file a petition in family court after which a notice may be served to the husband. After this there will be a hearing where both parties can bring witnesses. Maintenance may also be decided during his time .

                            It is very common in smaller towns. Parents first file a kidnapping complaint to locate their child that has eloped. Upon finding them, the person tells cops they left on their own accord. Now parents do drama and promise a grand wedding so nobody in the samaj says anything. Cops also suggest the person to go with parents politely.

                            Now when the person goes back, brainwashing happens and the whole thing is denied. This is where the witnesses come in because Now the other partner tries to file restitution of conjugal rights and the other side entirely denies it.

                            Even people who undergo kidnap weddings do not often get respite quickly .

                              This was done in Gujarat and went on for several years. Later it was closed down. It can have serious legal implications but if you have local support and thick skin, it can be a lucrative business.

                                  Also file a case against nri husband for second marriage if he is hindu . If he ever comes to India cops should be on the lookout. Better to retaliate and befriend local cops.
