      Ok then better to take help from local police. Try to find other illegal activities he might be involved in such as tax evasion, illegal construction etc. This is to ensure he cannot simply bribe local hawaldars cheaply and manage to get away with it.

        Usually all owners deduct some amount and return the rest. Is he refusing to give anything back ?

        Ideally you should have some evidence to prove that you gave notice. The first way is to negotiate and settle for what he is giving. If he is not giving anything you can try reaching local cops. ( They may not be co-operative but may have expectations.) . Filing a civil suit against him will be long and tedious but can be considered if nothing else works .

          Get the owner to involve the society president , treasurer. No point getting your hands dirty. If the owner is being lazy just ask him to initiate the proceedings and follow up with them yourself.

          Also try to befriend home owners who are living there.

            This is a civil matter and the court is also slow moving and passive usually. You should read about how such cases go on court websites.

            I know cases where even after the court gave judgement in favor of the petitioner, no money was revived . This is not to discourage you but to make you aware of ground reality so you can take your best action in a timely manner.

              Even after going to an actual lawyer and filing a recovery suit the likelihood of him giving your money back is very low.

                Was it a bearer cheque? Can you ask the person who gave the cheque to stop payment?

                If not bearer, The cheque is on the brother’s name only?

                In that case only theft case the way. Better to take local cops into confidence to explore unconventional ways too.

                  Log into NetBanking and stop payment of the cheque and file FIR for theft. If the matter gets resolved amicably, you can take the FIR back. Most likely it won’t be easy to FIR too so do not waste time because he may even move to another country with this money.

                    Should have sent her to some international school only. School will keep covering for their staff. You would have to gather serious evidence of wrong doing in order to initiate any action.

                          If the property in question is ancestral, she may have a case otherwise most likely you should be ok.

                          Also make sure to keep the property safe as in such cases people try to forcibly take possession as it is very difficult to remove someone and local cops may not help depending on how things are.

                              What they can do?

                              1. File a recovery suit against him.
                              2. If it is a small firm, they will not mind playing dirty and may even involve local police.
                              3. They can screw up background verification against him.

                                Go to the shop during busy hours and argue. Better to take some oldern women with you. They may try to cheapshame you .
