      If you were in the shoes of the bike’s owner, would you be willing to let it go without getting back the cost of the bike? That is what I meant by culpability (of the OP’s friend)

            EPFO has 2 components. One portion paid by the employee, and another (matched upto a certain % of salary) contributed by the employer. The employer portion cannot be deducted from your salary. Try to get an employment lawyer and speak to them in case of questions.

                Not answering your q directly, but:

                If the old property was in your father’s name, and the proceeds of that were to be used to buy a new property, but in a different name, then the original property’s capital gains taxes will still kick in. Your father will then need to pay that IT. Please talk to a CA before deciding in whose name you are going to buy the property.

                  One party signing the papers doesn’t make it official. If the 1st marriage in India was registered, then that should still hold valid. Both parties need to sign the divorce papers, those divorce papers need to be registered in an Indian court, accepted and finally the marriage is deemed annulled/ended. Till such time, the wife (if at all she married anywhere else) is liable for a polygamy case. If she’s in a live-in relationship without getting officially married, then the polygamy case will not stick. But, in that case, a case can still be filed in India for abandonment/absconding from marriage.

                    take this as a learning: when initiating any parting of ways, be it an employer, or if you ever are the employer – ensure that you have a paper trail.

                    If an employee, send the resignation email to your immediate manager, cc their manager AND your personal email address. This last bit is also important: if the company is very machiavellian, they can erase the whole email thread since they control the email server. Thus, having your personal address in cc (and expecting their “reply to all” to include replies to be sent to your personal email) is a standard safety measure that I follow.

                    Similarly, prior to initiating a resignation, take all relevant paperwork (like your original, offer letter, latest company policy as it might have changed since your employment start date), your leave balances as of that date, your current CTC, etc and email it to your personal address. This will ensure that they don’t suddenly change any policy to entrap you. (Most companies wouldn’t go to this extent, but you never know).

                      in the future, do not accept a cheque. you need to get a Demand Draft, and obviously keep it safe!

                      btw – could it be that the buyer arranged for the cheque to be “stolen”? If you suspect this, then lodge a complaint in the police station.

                        think of a different scenario: you pay the fees, and then the institute says no more seats available. Would you consider that fair? wouldn’t you be clamoring that “i have paid the fees, and so i should be guaranteed the seat”??

                          Also, remember that this was not the case for the first 2 years. Most likely, the abuse by you and fellow students has coerced the institute to put these fines in place.

                            when one signs up for a movie, do you pay the ticket price towards the end of the movie????

                            There’s an implicit expectation that for you to get a student id/roll number, and be allotted to classes, you will pay the due fees. Why is that so hard to accept?

                            Clarification need not be explicit (in this case).

                              Why would you think its not legal?

                              Most likely, the recipient (in this case the educational institution) got a lot of students abusing the leeway and paying the fees only towards the end (ie just before issuing hall ticket for the final exams). Till that time, they had to use other available funds to pay the ongoing operational expenses. Was that legal/immoral on your (students’) behalf?

                              What if some section of students, after almost all the course-work is done, don’t pay the fees and thus don’t appear for the exam? Isn’t that wasted effort/infrastructure from the university? Who will compensate them for that?

                                Labour Law applies to all companies (ie anyone hiring another person within the constructs of an employment).
