      Some senior lawyer working in Delhi HC and SC recommend not to return to India if DV or 498a ongoing as they can manage to take its tooth & vindictiveness in few years time. However with Parents and close relatives back home, its a difficult option to consider

              1. Tough way: formally file police report, ask protection, construct boundary wall and put up a Guard atleast. File a injunction petition and assert all possible legal claims in a white-collared manner

              2. Simple way: Tell parents to leave this enchantment of paternal land and jamin ka moh-maaya. Convince them to sell it off to another local guy, without getting neighbours or mohalla involved. U will find ample local strongman to buy but at discounted rate directly. And don’t expect any profit whatsoever

              3. Straight way: Read comments above and put up private security and gunmen. You will get it easily when u shell out money in our beloved Bihar State. But then if you are not going to reside there , is it worth it ?

              Btw, Panchayat will be useless in such case

                If you have proofs (or even no proofs) talk to another serious lawyer, file a FIR or a complaint case in local court and witness the long progress of law…..

                It May not achieve anything, but the way judicial queries will be asked on possible misconducts and demeanours will stress this guy out and you can watch the show and enjoy.

                But yet again whom are we talking to and where – so if you can just muscle around, you can give fitting response then and there.

                Btw, dont worry about family etc . Typically low key uncouth guys have no guts to do anything except for spewing venoms here & there unceremoniously

                    1. Get your father properly treated for hypertension
                    2. In our motherland, complaint against judges will go nowhere, and can further worsen your own case
                    3. Next time, sit with lawyer a day or two before to properly prepare for hearing. Trying to argue (reasonably or unreasonably) with opposite side is never seen as good by any presiding Judge

                      If she or you not willing to go to police or lawyers, just call Women’s cell and they will send counsellors to question the husband & rest. This will be more of a deterrent and in future used as some sort of evidence for DV .

                      Also, in case of physical abuses & bruises – tell her to go to any Govt. clinic or hospitals to get primary care and first aid. And get a written report from Doctor incharge. It will be another strong evidence to keep

                        Mr Optimistic NRI . Sad , but now you are in a desi arrange marriage trap. Its not unusual that girls are ‘forced’ by their families to appear ‘Sanskari’ – and guys (typically poetic romantic NRIs) getting swayed .

                        Further legal marriage means – all consent or background everything cannot be disputed so easily for annulment (unless girl or you were alrd legally married earlier). Also its barely 5 months and no legally significant ground is present. So
                        take a deep breath, and come to terms with it.

                        Suggest you settle down your emotional upheavals, talk to her, give it another try, let some spark fly, involve some intermediaries to counsel ‘shaadi ka matlab kya hota hai’ to the girl – and that may lead to some clear outcome. Do check if the girl is not suffering from critical mental illness (on medication for psychotic not psychiatric illness). If she is , its a separate matter – and you have grounds for annulment, but gather some evidences about it (thru medical shops, local jasoos, doctors, sarkari hospitals with psychiatric ward)

                        If it all fails, u still can claim how ‘adarsh’ and committed you were to your marriage and tried as much as possible to make it successful

                        Alternatively, if you really have time & interest on your side – pls get lawyers, courts, police etc involved – and do be sure opposite side will do the same, fight a nonsensical legal battle for years with no end, pay maintenance or settle out of courts , and all this while loose your youthful state. In your case , Courts will be super lenient to the Girl – so her lawyer can play it to call u in front of Judge every few months.

                        Think wisely before, in India context, you plan to proceed with divorce. Its just too complicated and frustrating out there …

                          While general response is almost always about going for MCD or fault-free agreements, on a second & wiser thoughts – try to improve the situation. Talk to some common relatives for both families , go find a job in metro like Kolkata . Her only disagreement is not to leave her job and come live with you & parents in Odisha (which most working girls demand after wedding)

                          This kind of reason will not fly far in courts, and all the current differences will no longer exists once ice starts melting between the two of you.

                          Making the matters legal at this stage with further complicate matters, and drive a much wider wedge, no looking back kind of situations. Talk to parents also to give some amenable advise

                              1. Lodge a police report for missing/stolen papers, and the follow the process for duplicates issue from registry office. You may get mutation details & annual cess paid online these days -as a backup to prove ownership
                              2. Make up your mind to dissolve your marriage. Consult a lawyer.
                              3. Silently file a informatory petition in local cjm/district court with details of her misdeeds and thefts, deserting, giving threats etc. subsequently file divorce petition
                              4. Later get a dv petition filed by your mother against your wife. If possible, get a restraining order granted
                              5. If situation get worse and she keep coming to threaten, let ur dad visit local thana and file a complaint. And request for protection

                              Ultimately, prepare for a long nonsensical legal battles leading towards some kind of settlement and mutual divorce. In the meanwhile keep paying (with records) some amount every montj – so she cannot push harder for maintenance

                                Please talk to a civil lawyer, they may find one way to other as to why your petition shud b allowed after limitation period of 3 years. This kind of cases are not uncommon

                                  Yes, if you die intestate.

                                  hence her non-eligibility as a legal successor to your properties needs to be clearly written down in divorce settlement agreements (in case u get mutual divorce or request judge to clearly put in judgement for contested divorce)

                                  Alternatively, just write a will and put some other trusted person as your legal successor (so marriage or divorced spouse claims will not be considered as relevant). Get it legalised/registered so there is no loopholes later for anyone to exploit
