Without any lawyers help, its absolutely impossible. He will need to pay the lawyer to fight his case of bail and in murder cases judges don’t easily grant bail before 2-3 years unless you are the son of an influential politician or you send a few gandhiji to judges. Even Manu Sharma was granted parole after three years, thou by the govt not court.

If his family did not assist him than he either himself had money or he made a deal with some influential gangster in jail.

He will need to spend money on a good lawyer for this. My family has many lawyers and all say that the top most reason for a person to be screwed over in court is bad lawyer. Many hire on recommendations of their family many hire the chhatriwala outside the court because they are cheap and they get what they pay for.

In India, you don’t get Justice, you buy justice. If you have the money to hire Harish Salve/Mukul Rohatgi, then you can get Justice.

Here, SC and HC are known to give divorce after 25-30 years of living Separately. You need to fight dirty. Spend your hard earned money on goons or you will keep fighting for next 20 years.

If you are Indian citizen, then yes you can but both you and your ex will have to appear in the court and will have to sign an affidavit regarding the terms of child custody, alimony, and property division, to proceed smoothly. After that a cool off time of six months will be given by the judge and after 6 months, you and your ex will appear in court again and the court will grant divorce.

In short, you will be better off spending 2-3 lakhs going to abroad for divorce.

You are wrong. Division of asset is not 50%. In most western country, division of asset accumulated after marriage is 50%. And even than most of the courts consider the length of the marriage and contributions made to the marriage. Meaning men in western countries don’t have to pay lakhs if they had hired maids and/or were married for less than 3-5 years and also don’t have to go to jail in false dowry(498A) or the so-called unnatural sex(sec 377) cases. Other things which you have mentioned like child support laws etc are also better for men in western countries.

You got scammed. plain and simple. You should have done more due diligence. Are you not watching the news? Even right now you appear to be naive thinking that reconciliation is possible. You need to start legal action. Hire a well-known lawyer, (spend the money on lawyer and you will have to spend less on alimony and maintenance) and start sending notice. You can’t do anything else here. You know that the more you delay the more you will have to pay the maintenance and alimony in case of divorce, right? Also, be prepared for a barrage of false cases including 498A and 377. I repeat once again, you can do nothing except accept that divorce is the only choice.

I don’t know which country you are from but in India, parents save for years for their children’s marriage, and they keep the money handy once their kids reach the age of marriage so that they can use it whenever the marriage id=s fixed. Literally everyone does it, at least in case of arranged marriage. Your other points are valid.

In real India, out of Redditosphere, bonds have always been valid but with certain stipulations. โ€‹Under section 27 of the Indian Contract Act, 1872, no company can stop any employee from leaving the company, but various SC judgements has held that employers are allowed to seek compensation for expenditures on training “provided that the compensation required is reasonable”. Company needs to prove that they have spent the money to train you and with your premature exit they will be suffering from the loss of money and time taken to train new employee. Courts also takes into consideration the time employees have spent on the job so if your bond amount is 1.5 Lakhs for 3 years and you are leaving after 2 years, you may have to pay 50,000 or less.

There’s no law as far as I know but various high courts have observed that pepper spray is dangerous chemical weapon to life and hence can’t be used unless your life is under threat. So basically, unless you have proof that someone wants to kill you, there is a chance that you will be convicted, if you use the pepper spray on a stalker or harraser. Judge will ask you why you didn’t go to police despite knowing the ground reality.

Though I am sure no Indian judge will convict a sexual assault victim for using pepper spray, can’t say what milords’ judgement will be in case of someone using it on a “potential” assaulter. In most extreme cases it can even like Netherlands where if you scratch your potential rapist with your nails to fight with him off or slap him, you will be prosecuted for attacking someone. Can’t say with Indian Judges.

If you signed the divorce papers when they don’t want to withdraw the false cases than you will be screwed. There’s no two way about it. I don’t know what kind of incompetent lawyer you have hired but any other lawyer would easily see that for some reason, your in laws wants to get the divorce as soon as possible and would capitalise on it to get the cases withdrawn.

Do not sign the papers at all till they withdraw the case. In fact I would suggest you to get a competent lawyer and beg the court to not give you divorce. This will frustrate your in laws who will compromise and withdraw the cases. It’s possible that your ex wants to get remarried so wants the divorce as soon as possible. Ask the court to cancel the divorce case, use words like culture, family, tradition etc and you will have upper hand in the negotiations with your ex.

Did you guys hand over the culprits to police? Or should the first years wait 10-20 yers that court will take to get justice. The way to avoid collective punishment is to stop criminals committing the crime or to hand them over when police comes knocking, instead you guys seem more interested to shield them by blaming some outsider.
